IRLI opposes move to lift injunction in appellate court

 

WASHINGTON—Yesterday, the Immigration Reform Institute (IRLI) filed a friend-of-the-court brief in the Fifth Circuit Court of Appeals opposing an emergency motion by the Biden Administration to suspend, pending appeal, a district court's injunction against the administration's immigration enforcement priorities, which have resulted in the release of many dangerous criminal aliens into the country.

 

In its brief, IRLI shows how these enforcement priorities violate the law by preventing immigration officers from taking mandatory enforcement actions against a broad range of aliens. Under the enforcement guidelines, officers may only use their authority to apprehend, detain, or remove terrorists, spies, other national security threats, those who entered the United States after November 1, 2020, aggravated felons, and criminal gang members. Officers are blocked from apprehending, detaining, or removing any other aliens, including the vast majority of criminal aliens. Because of this patent illegality, IRLI demonstrates, the administration has no chance of success in its appeal of the injunction, and thus the injunction should not be suspended during that appeal.

 

In its brief, IRLI also places Biden's priorities in their larger context: a whole series of Biden non-enforcement policies that, working together, have explosively increased unlawful entry by aliens—including many fugitives from justice and other criminals—from around the world.

 

"It is simply undeniable that the Biden plan is to reduce enforcement to such low levels that illegal entry, including entry by criminals, keeps skyrocketing," said Dale L. Wilcox, executive director and general counsel of IRLI. "The enforcement 'priorities' stand-down a key component of this deliberate, across-the-board policy. We need relief from the enforcement stand-down now, not after a lengthy appeal. We hope the court sees the low chance the administration has of winning its appeal, and keeps the injunction in force."

The case is Texas v. United States, No. 21-40618 (Fifth Circuit).

I've been on the road the last few days, and I've seen how many Americans have been gripped by anger, sadness and mourning. I've seen flags on homes lowered to half-staff. I know there were many prayers for the families of our fallen heroes in many churches this Sunday. 

But there was something else springing out of Trump's America. It's not clear who started it, but at bars and restaurants all over America, tables were set with 13 empty places. Some included 13 drinks. In some cases, a small American flag was placed at the table. Others included the names of the fallen. 

No one dared disturb the tables at whatever establishment they were in. This was an example of what Abraham Lincoln referred to as the "mystic chords of memory" that unite patriot graves everywhere.

There's a song from Les Miserables, "Do You Hear The People Sing," that became an anthem of the MAGA movement. But there's another song from that same play called, "Empty Chairs At Empty Tables." Here are some of the lyrics:

"There's a grief that can't be spoken
There's a pain goes on and on
Empty chairs at empty tables
Now my friends are dead and gone. . .
 
"The very words that they had sung
Became their last communion
On this lonely barricade

Kudos To Col. Scheller!

Remember this name: Lt. Col. Stuart Scheller. Scheller posted a video last week demanding accountability from the military brass for the fiasco that has taken place in Kabul. 

"I want to say this very strongly: I have been fighting for 17 years," Scheller said. "I am willing to throw it all away to say to my senior leaders: I demand accountability."

Not surprisingly, he was relieved of command. Scheller posted a second video on Sunday announcing that he was resigning immediately, just three years short of retirement. 

I hope Scheller's words trigger a new grassroots movement, just as Rick Santelli's famous rant launched the Tea Party movement. Americans of all backgrounds are beyond frustrated by the lack of accountability in government. 

There has been no accountability for the way our intelligence agencies attempted to bring down Trump's presidency. No one went to jail for using a debunked dossier, partisan opposition research, to undermine the duly elected administration. No one who lied to the federal courts to get illegal wire taps went to jail.

They tried to put Michael Flynn in jail. They want to put Trump's lawyers in jail. But any leftist who breaks the law to advance the cause of the left gets a job on CNN and a big book contract.

This Marine speaks truth to power, calling out the chain of command, and he's out of a job. Meanwhile, Lt. Col. Alexander Vindman leaked a secret phone call, hoping to take out the commander-in-chief over a policy dispute, and he's celebrated as a hero. 

Once again, the double standard of justice is on full display. It's beyond disgusting, and it needs to end!

Kudos to Col. Scheller for speaking out. He speaks for millions of Americans who want accountability for this needless loss of life and the damage done to our national honor.

Victory! Supreme Court Keeps Wait in Mexico Policy in Force

High Court refuses to lift order reinstating program

 

WASHINGTON—Last night, in a major victory, the U.S. Supreme Court declined a request by the Biden administration to suspend an order that a Texas federal district court had issued resuming the the key Trump immigration policy of returning asylum seekers to Mexico to wait for their asylum hearings in that country, rather than in the United States. In so ruling, the Supreme Court agreed with a friend-of-the-court brief the Immigration Reform Law Institute (IRLI) had filed with the Court opposing the administration's suspension request.

 

In its brief, IRLI showed that the administration was very unlikely to win on the merits of its appeal, because the administration had not given any rational explanation for rescinding the wait in Mexico policy, making that rescission arbitrary and capricious. Last night a majority of the justices agreed, stating that the administration had "failed to show a likelihood of success on the claim that the memorandum rescinding the [wait in Mexico policy] was not arbitrary and capricious."

 

The effect of the Court's ruling is that the wait in Mexico policy will continue pending the administration's appeal—which will probably be unsuccessful. Following the Court's decision, the Department of Homeland Security stated that it will implement the wait in Mexico policy "in good faith."

 

"This ruling is hugely important, both because it means that the administration's attempt to delay the restoration of the wait in Mexico policy has failed and because it shows that the administration most likely will lose its appeal of the district court's order," said Dale L. Wilcox, executive director and general counsel of IRLI. "And under that district court order, the wait in Mexico policy is back in force until the border is under control. For these reasons we are very pleased with the Supreme Court's decision, and remain dedicated to reversing all of the administration's other unlawful policies that, by design, have created the crisis at the border."

 

The case is Biden v. State of Texas, State of Missouri, No. 21A21 (Supreme Court).

Rep. Bob Good: I Stand with Americans in Afghanistan


This week Joe Biden failed as Commander in Chief. He has placed many American lives at risk and has avoided speaking to the American people about his lack of an evacuation plan. Though, on Wednesday, with thousands of Americans still stranded in Afghanistan, President Biden took the time to hold a press conference about his ongoing efforts to force Americans into getting yet another shot. This is simply unacceptable. 


It has been a sad week for America, our allies, and Afghani citizens. It has been especially sad for those who have courageously served this nation for the last 20 years, only to be recklessly abandoned by President Joe Biden. It is a disgrace to our nation. It is a disgrace to the men and women who have fought our battles, and those who lost their lives in the name of Freedom. I pray that the Americans trapped in areas of Afghanistan find refuge and safe passage to the United States.  


My staff is continuing to try to assist constituents impacted by the current events in Afghanistan.

TINA RAMIREZ FOR CONGRESS: STANCE ON AFGHANISTAN

Regardless of where you stand on America's involvement in Afghanistan over the past two decades. It has been made apparent that Joe Biden's expedited and careless withdrawal has created an entirely preventable foreign policy disaster.

Joe Biden addressed the American People and stated that the Taliban would not regain control of the Country. Now we see that the Taliban was able to take control in a matter of days.

Senior Military leadership made it abundantly clear that this exact scenario would unfold.  Joe Biden either lied directly to you or is astoundingly ignorant.

But now, as we watch Afghanistan unravel what our dedicated service members sacrificed to build and support, and as we watch a human rights disaster and a national security crisis unfolds, Biden is hiding at Camp David.

This is disrespectful to the thousands of lost lives and squandering of trillions of tax dollars.

Our Military deserves better.

Our US personnel deserve better.

Our Afghan allies deserve better.

And the women and girls of Afghanistan deserve better.

We need real leadership and experience guiding our foreign policy. There is too much at stake for us to tolerate this level of incompetence and recklessness.

Victory! Wait in Mexico is Back

Court orders program must resume until border under control

 

WASHINGTON—In a major victory, a Texas federal district court on Friday ordered the resumption of the key Trump immigration policy of returning asylum seekers to Mexico to wait for their asylum hearings in that country, rather than in the United States. In so ruling, the court agreed with a friend-of-the-court brief the Immigration Reform Law Institute (IRLI) had filed in the case. Attorneys United for a Secure America, a project of IRLI, also filed a brief in the case.

 

As the court noted, the policy had been very successful in discouraging meritless asylum claims, since aliens could no longer make such claims as a quick way of being released into the United States. When the Biden administration rescinded the policy and started releasing asylum seekers into the United States again, it did not even mention how effective the policy had been, or explain why it was getting rid of it despite its effectiveness. This failure to explain, the court found, made the Biden rescission of the policy—which has helped set off the current border surge—arbitrary and capricious.

 

The court also noted that federal law requires the detention of asylum seekers pending their hearings if they are not returned to Mexico, and that immigration authorities currently lack the facilities to detain the massive surge of asylum seekers the rescission of the wait in Mexico policy has caused. The court accordingly ordered that the wait in Mexico policy must be resumed, and may not be rescinded again until the government has the capacity to comply with the law and detain the asylum seekers it does not send to Mexico.

 

"This is a massive victory, and shows the courts can be effective in combatting the border crisis the administration has deliberately created," said Dale L. Wilcox, executive director and general counsel of IRLI. "As a practical matter, this ruling means that the wait in Mexico policy is back in force until the border is under control. We applaud the court for its strong, thorough, and well-reasoned decision, and remain dedicated to reversing all of the administration's other unlawful policies that, by design, have created this crisis."

 

The case is State of Texas, State of Missouri v. Biden, 2:21-CV-067 (N.D. Tex.).

September 9th Candidate Forum

The Madison American Legion Auxiliary and Family, the Original Madison Matters, and the MadRapp Recorder will host a Candidates Forum at the American Legion Hall, 310 Thrift Road, Madison from 6:30 - 9:15 p.m., Thursday, September 9th. Local candidates for the Board of Supervisors and the School Board have been invited to participate.

Questions from the audience may be submitted in person from 6:30 p.m. until 6:45 p.m. All questions will be pre-screened and submitted to the moderator. The Forum is non-partisan and an educational service to the community. This is an opportunity for interested voters to learn the candidates' priorities and goals. Voter registration will be available to those new to Madison or who need to change their registration.


Are You A Slave To The Left

Are we peasants, serfs, or - even worse - slaves? Of course, we aren't. 
 
But our leftist leaders increasingly act like we are. 
 
You probably noticed that Barack Obama went ahead and had his big birthday bash in Martha's Vineyard.
 
Hundreds of people attended. They partied under a big tent with poor ventilation — and of course no one was wearing a mask. When the event came in for criticism, several media commentators pushed back by saying Obama and his guests are "sophisticated people." You know, smarter than us regular folks.
 
The crowd that gathered were many of the same leftists who are telling us we have to mask up when we walk into a store or if your kid wants to have a birthday party with a few of her friends.
 
Then there's Rashida Tlaib, the anti-Semitic congresswoman from Michigan. She is a terrible person. She attacked Senator Rand Paul for asking questions about the Biden administration's COVID strategy and demanded he stop playing politics with COVID.  She made her point while wearing not one but two masks.
 
Then she was caught on video at a big wedding dancing unmasked in a crowded ballroom full of other unmasked people.
 
Congresswoman Cori Bush is the leader of a group of leftists who want to shrink America's police departments by defunding the cops. Then we discovered she has four beefy guys who guard her 24 hours a day at the cost of $200,000 a year. Her message is, police for me but not for thee.
 
These liberal elites don't even try to hide their double standards. They're telling you how to live, restricting your freedom, shrinking the size of your life while they live "big."
 
They are not kings, dictators, nor do they own us. And we are not their subjects, serfs or slaves. We are free men and women whose rights come from the King of Kings, the God of the universe, not from these blue-blooded tyrannical socialists.
 
More than anything right now we need to stand up, be strong, not falter and live like the free men and women we are.

National Day of Remembrance for Aborted Children - September 18, 2021

On Saturday, September 18, 2021, Priests for Life will again co-sponsor the annual National Day of Remembrance for Aborted Children, calling on pro-life Americans to gather at the gravesites of our aborted brothers and sisters. I am happy to have co-founded this project. 

Solemn prayer vigils will be conducted at these gravesites, of which there are 56 across the United States, as well as hundreds of other sites dedicated in memory of aborted children.

Too often, abortion is dealt with in purely conceptual, philosophical, or theological terms; but it's about real bloodshed, read victims: The over 61 million American children who have lost their lives to abortion since 1973. Most of them never get a proper burial. But some of them do, after pro-life people retrieve their bodies from dumpsters.

Visiting the burial places of these children cuts through any rhetoric surrounding abortion and removes this conversation from the abstract into concrete reality.

Please also consider planning a memorial service yourself if there is a site near you that is not yet scheduled to have one.

JON RUSSELL FOR CULPEPER MAYOR TO HOST TWO EVENTS ON SATURDAY AUGUST 14

Jon Russell & Virginia Delegate Nick Freitas will be hosting a free breakfast for Culpeper veterans at Moving Meadows Farm Bakery & Café located at 307 S Main St, Culpeper, VA from 8am-9am. All Culpeper area veterans are welcome to attend. Jon & Nick will be addressing veterans' issues at the state and local level.

Culpeper, Coffee & Cars Cruise-in will be held at the home of Jon Russell located at 405 Sperryville Culpeper VA. Show cars & classic cars are welcome to participate free of charge and free coffee will be provided. Volunteers will be on hand to help with car placement and parking. 8am-10:30am

Ninth Circuit to Redefine Illegal Reentry?

IRLI urges court to close loophole for repeat illegal aliens

 

WASHINGTON—Yesterday, the Immigration Reform Law Institute (IRLI) filed a friend-of-the-court brief before the full Ninth Circuit Court of Appeals, sitting en banc, in a case that will decide the meaning of "illegal entry" for purposes of reinstating removal orders.

 

Under the law, when an alien who has been subject to a removal order and deported later reenters the country illegally, the original removal order is reinstated and the alien is deported again pursuant to it. In this case, an alien from Canada was deemed inadmissible on the basis of possession of a controlled substance and deported pursuant to a final order of removal. He later reentered the United States, but claims he did not do so illegally because a border patrol agent waved him through a checkpoint. Thus, he claims, his prior removal order should not be reinstated.

 

In its brief, IRLI points out that an inadmissible alien who reenters the country does so illegally even if his reentry was procedurally regular, because entering while not being properly admissible is a recognized form of illegal entry. To limit "illegal entry" to the method of passage through the border itself would create an incentive for inadmissible aliens who had been deported once to try to enter again, in the hopes of wiping out their prior removal order.

 

"Congress intended repeat illegal aliens to be deported swiftly the second time, without the government having to go through the process of procuring a second removal order," said Dale L. Wilcox, executive director and general counsel of IRLI. "We hope the full Ninth Circuit sees this, and refuses to create a loophole for inadmissible aliens to benefit from the mistake or inattentiveness of overworked border agents."  

 

The case is Tomczyk v. Garland, No. 16-72926 (Ninth Circuit).

VIRGINIA BEACH -- Just one day after Smyth County Sheriff Shuler was falsely listed as endorsing Mark Herring, Dickenson County Sheriff Jeremy Fleming has also come forward to call out Mark Herring's lack of support for law enforcement and endorses challenger Jason Miyares.

"Over the past eight years, Mark Herring has abandoned law enforcement. As the extreme wings of the party degraded us and called for us to be disbanded and defunded, Mark Herring did nothing - he left us defenseless and unsupported.

This is why despite my political affiliation with the Democrat Party, I am publicly endorsing Jason Miyares for Attorney General - NOT Mark Herring. Jason has proven time and time again that he supports law enforcement and that his number one priority is Virginians - not politics.

This November's election is bigger than Republicans vs Democrats. Virginia's at a tipping point, and we need an Attorney General who sees the whole picture. Jason Miyares doesn't care about political gains - he cares about keeping our communities safe, and that's why I'm voting for him this November." said Sheriff Fleming

Yesterday, Mark Herring released a handful of sheriff endorsements. Alongside Smyth County Sheriff Chip Shuler, Dickenson County Sheriff Jeremy Fleming was falsely listed as an endorsement. Despite saying he wasn't going to endorse Mark Herring, the Herring campaign deliberately listed him because of his political affiliation with the Democrat party.

"From day one I've said that my mission is Virginia's safety. Standing with our brave men and women in law enforcement and making sure that they have the resources and support they need to protect our communities is one of my top priorities," said Jason Miyares

"Sheriff Fleming recognizes that this election isn't about party politics, but what candidate puts public safety above all else. I'm running to make a safe and secure Virginia for ALL Virginians - Republican, Democrat, and Independent. I'm honored to have his endorsement and look forward to working with him when I'm elected as Attorney General this fall."

You probably heard about the recent event in Massachusetts where a lot of vaccinated people got breakthrough COVID infections. This event was reportedly what caused the CDC to reimpose its latest mask mandate. 
 
Well, there's a lot about that event that no one at the CDC or the media told us. It was an annual gathering of gay men engaging in heaving drinking, drug use and promiscuous sex. In short, it was a bizarre model on which to base public health policy for the rest of the country.

Speaking of COVID, today's dose of liberal "tolerance" comes from Kate Coyne-McCoy, a top official at the Rhode Island Democrat Party. Referring to Sen. Lindsey Graham's announcement that he has tested positive for the virus, Coyne-McCoy tweeted, "It's wrong to hope he dies from Covid right? Asking for a friend."
