Jonathan Emord: I Went to the Border

The Biden administration's open border policy has invited the most violent and lawless to flock to America and enter our country with virtually no impediments.  The unvetted come here neither pledging allegiance to the United States nor relinquishing their citizenship and loyalties to foreign powers.  Our government is giving each at taxpayers' expense cash, a cell phone, health care, legal help, transportation, and lodging.  NGOs operating almost exclusively on federal grants buy the illegal aliens' bus, train, and plane tickets to wherever they wish to go across the country.  For upwards of eight months, their livelihood is financed by tax dollars.  Our tax dollars are literally paying for the invasion and destruction of own country.  This massive welfare to the world and without limit grows every second of every day indefinitely into the future. 

I just came back from an eye-opening CBP tour of the U.S.-Mexico border (San Diego Sector).  CBP agents who formerly policed the border have been reassigned to human processing, leaving our nation largely defenseless.  Just one of the massive 132,000 square foot human processing centers cost taxpayers $32 million to construct (a huge white tent with detention pods inside) and $9 million monthly to operate.  Along the border, CBP drove me to areas of peculiar national security interest, all left unprotected.

In one, CBP showed me where water sometimes flows from Mexico to the United States.  To accommodate the flows, large drainage tunnels have been constructed out of concrete.  CBP welds onto the openings of the tunnels iron grates.  Cartel agents who carry diamond cutters on their belts regularly cut the grates to facilitate illegal entry of drugs and gangs.  As the clip of me at this border intersection reveals, the tunnels into the United States were open at the time of my visit.  

In another area, you can see where the Biden administration ordered border wall construction halted.  That area, the Zone 18 border gap, is wide open.  On the Mexican side there are cartel dwellings.  Before my visit, two illegal aliens crossed onto American soil at Zone 18 between the Mexican side and the wall for the American side, an area CBP calls "no man's land."  Cartel members tracked the aliens into no man's land and shot them for failing to pay their full ransom for entry into the U.S.  One died.  The other was rescued by CBP and survived.  When U.S. authorities alerted their Mexican counterparts of the incident, 8 more bodies were found on the Mexican side, apparently of those who also failed to pay their full ransom.  In this same area, CBP told me they found a large vat of acid into which bodies of those executed were placed to reduce them to bones for discarding.  This grizzly criminal and inhuman trade the Biden administration facilitates by refusing to defend the American border.  Each illegal alien on the way to America is robbed and victimized by the cartels.  Women are sexually assaulted.  Children are abused and trafficked.  Many die before they reach the U.S. border.

In a third area, the CBP showed me where on the Mexican side the cartels dug dozens of deep tunnels traversing the border underground and extending some one-half to two miles into American interior.  Through these tunnels, the cartels smuggle drugs with armed Mexican police escorts (corrupt police, of course) into vacant warehouses on the American side.  The warehouses are ordinarily empty at night when the illicit trafficking takes place.  Here is where I identify one of the warehouses used by the drug smugglers.  CBP has no idea the full extent of tunnels operating nightly but believes dozens are now operational.

In a fourth area, I encountered a young man from Ecuador at the border wall.  I asked him why he did not seek asylum at the U.S. embassy in Ecuador.  He said that was too bureaucratic and required a lot of paperwork.  To avoid the hassle, he came to the border.  I asked him where he planned to go in the United States.  He said Manhattan (where he will find thousands of fellow illegals overwhelming that city).  This is my interview with the man from Ecuador through the border wall.

The CBP informed me that the draw-down of agents at the border and the effective abandonment of border protection has led to a massive increase in criminal entries, including drug smugglers, sex traffickers, gang members, and terrorists.  I was told that fewer than 1% of violent criminals are being interdicted on their way to the United States.  Even when those suspected of crime are caught, because CBP ordinarily lacks histories on those it arrests, it is obliged by Biden administration policy to let them go into the U.S.  I was also told that ultralight aircraft and drones are being used by the cartels for nightly drug drops in remote mountainous areas and that the CBP has no resources from the Biden administration to act against these air space intrusions.

The Biden administration's legacy is defined by this incessant invasion of our country and destruction of Americans' lives and property.  Among us today are terrorists, drug smugglers, sex traffickers, and gangs intent on raping, pillaging, and destroying, all here courtesy of the Biden administration.  Their numbers will easily double between now and the November 2024 presidential election.

IRLI Sues USCIS for Refusing to Provide Emails with ‘Abolish ICE’ Founder

Radical activist had successfully lobbied ICE to keep criminal alien in the country

[Note: The previous release on this case should have identified the defendant as U.S. Citizenship and Immigration Services.]

 

WASHINGTON—The Immigration Reform Law Institute (IRLI) has filed a lawsuit in federal district court against U.S. Citizenship and Immigration Services (USCIS), seeking to compel the agency to produce emails with a radical anti-borders activist.

 

In August 2021, Tucker Carlson revealed emails showing that officials at the highest levels of Immigration and Customs Enforcement (ICE) had kept an illegal alien with multiple criminal convictions in the country at the personal behest of extremist Tania Mattos, who is a founding member of a group called the Abolish ICE NY NJ Coalition, dedicated to terminating funding for the nation's primary immigration enforcement agency. 

 

In May of 2022, seeking to uncover what direction Mattos might have given to the Department of Homeland Security's (DHS) other main immigration agency, IRLI submitted a Freedom of Information Act (FOIA) request to USCIS for any email communications Mattos had with their employees. 

 

Under FOIA, an agency is supposed to determine whether and to what extent it will comply with a request and provide relevant public records within twenty working days. However, roughly a year and a half after IRLI's request was submitted, USCIS had still produced nothing in response to IRLI's request. Accordingly, IRLI filed suit to compel production of the requested information.

 

"This administration has proven to be extremely reluctant to allow any sunshine on the relationship between its agencies and the radical illegal immigration advocates who appear to have great influence over agency decisions," said Dale L. Wilcox, executive director and general counsel of IRLI. "The American people have a right to know who is running their government, especially if it is members of shadowy groups with radical agendas for the country."  

 

"When DHS fails to provide government records this basic, one can't help but wonder whether it is trying to cover up a clear conflict of interest - or something worse," said Matt O'Brien, IRLI's director of investigations. "Is this a case of Biden Administration senior executives at DHS improperly and unlawfully allowing anti-borders radicals to set immigration enforcement policies?"

Biden Suspends the Law

IRLI shows an administration parole program lifts Congress's restrictions

WASHINGTON—The Immigration Reform Law Institute (IRLI) has filed a brief in a case challenging the Biden administration's Central American Minors (CAM) program, in which families separated by the illegal immigration of their members are reunited on American soil by granting them "legal" status.

 

The "legal" status handed out automatically to a large class of illegal aliens in the program is called "parole." But, as IRLI shows in its brief, Congress deliberately restricted parole in 1996 so that it could only be granted on a case-by-case basis to individuals, and not given to classes of aliens programmatically, as is done under CAM.

 

The CAM program's abuse of parole has several consequences. One is that CAM does not actually provide legal status, because the parole handed out is unlawful. Another is that CAM is contrary to law, and so should be vacated under the Administrative Procedure Act.

 

Yet another consequence, IRLI shows, is that CAM is unconstitutional. Under the Constitution, administrations have to follow the laws passed by Congress. If they suspend the laws for a large, defined class of people—simply dispensing with the law as applied to them—they fail in their constitutional duty to take care that the laws be faithfully executed. In CAM, the administration simply waived the law's restrictions on parole for the many beneficiaries of the program.

 

"When members of families choose to split up by breaking our immigration laws, those laws do not preclude their reunification, but neither do they give them legal status so they can be reunited here, instead of abroad," said Dale L. Wilcox, executive director and general counsel of IRLI. "There could be no greater incentive for illegal immigration—including the dangerous illegal migration of children—than a law like that. The administration breaks our constitutional order when it suspends this necessary policy choice the law has made in favor of its own goals. We hope the court sees the deep constitutional problem with this program, and rules against the administration."

 

The case is Texas v. Biden, 3:22-cv-00780 (N.D. Tex.).

FRC's Statement Regarding Newly Released CDC Abortion Data

WASHINGTON, DC -- Today, the Centers for Disease Control and Prevention (CDC) released new data showing abortions increased by five percent between 2020-2021. Family Research Council's Director of the Center for Human Dignity, Mary Szoch, released the following statement in reaction:

"From 2020-2021, the number of abortions increased by five percent. This means that the U.S. Supreme Court's Dobbs decision giving elected officials the power to protect unborn children from abortion came at the time when unborn children's lives were most at risk. The time to protect the unborn is now! Additionally, this data shows that 56 percent of abortions occurred using the dangerous chemical abortion drug, mifepristone. While every abortion is tragic because it ends the life of an unborn child, abortions using the abortion drug, mifepristone, are especially horrific because of the great risk they pose to the mother's health, and sometimes her life, as well. The CDC data shows that six women and 625,978 unborn babies lost their lives from legal and induced abortion. This number is undoubtedly an underreporting. It is devastating, as each of these women and each of these babies have incalculable dignity and worth. Let us pray for the day when no unborn child and no mother is targeted by the abortion industry."

Congress Prepares to Fund the Border Crisis Into 2024 While Biden Administration Continues to Break Records

The following statement was issued by Dan Stein, president of the Federation for American Immigration Reform (FAIR), demanding that any spending package include strong policy changes that will end the Biden administration's dangerous border policies:


(November 14, 2023,Washington D.C.) "Nationwide encounters of illegal aliens attempting to enter the country, once again, exceeded 300,000 in October, while House Republicans are set to approve another Continuing Resolution (CR) that continues to fund the Biden administration's disastrous border policies into February 2024.


"Even as top national security experts issue dire warnings of terror threats posed by our wide-open borders, congressional leaders are again failing to use the CR as an opportunity to force the Biden administration to end policies that place our nation in grave danger. While the Biden administration must take responsibility for the policies that resulted in 309,221 border encounters last month, Congress must be held accountable for their complicity. House Republicans have squandered a full year of their two-year control without passing a budget that forces the administration to end its reckless border and immigration policies. Halting the Biden Border Crisis was an explicit promise they made last year when they asked American voters to entrust them with the leadership of the House.


"H.R. 6363, the Further Continuing Appropriations and Other Extensions Act, extends the budget enacted by Nancy Pelosi and the Democrats in 2022 into 2024. Rather than including changes needed to regain control of our borders by ending the mass release of illegal aliens, stopping asylum abuse, and limiting parole, this bill would reinforce the status quo.


"This failure is particularly egregious as the House has already passed H.R. 2, the Secure the Border Act, which contains strong provisions to do exactly that. Labor Department’s Migrant Worker Protections Misfire

IRLI's attorneys group comments on proposal's flaws

WASHINGTON—Attorneys United for a Secure America (AUSA), a project of the Immigration Reform Law Institute (IRLI), has filed a public comment to a proposed rule change by the Department of Labor (DOL) called "Improving Protections for Workers in Temporary Agricultural Employment in the United States." In this proposal, DOL declares that its aim is to protect foreign migrant laborers from abuse by their employers.

 

To that end, DOL proposes added enforcement of existing migrant-protection rules through site visits and revocation of employer visa petitions for noncompliance. But, as AUSA points out, these proposals are so vague and lacking in detail that it is hard to see what they would actually accomplish. Similarly, DOL purports to crack down on inappropriate third-party staffing of migrants, but fails to set forth any means of verifying that these third parties are what they claim to be, and are not, in fact, human traffickers. And the proposed rule, through its title refers to protecting temporary agricultural workers in general, has another glaring omission: it provides no protections for American laborers.

 

"Protecting foreign laborers in the United States on visas from abusive employment practices is a worthy goal," said Dale L. Wilcox, executive director and general counsel of IRLI. "But this proposal furthers it very little, while doing nothing for American seasonal farm workers and nothing to stop human trafficking. We recommend that the Labor Department withdraw and redo this proposal so that it better achieves the purposes of the legislative programs it is supposed to implement."

 

The proposed rule is DOL Docket No. ETA-2023-0003: Improving Protections for Workers in Temporary Agricultural Employment in the United States.

Is the United States a Sanctuary Country?

IRLI shows lower court wrongly stripped U.S. Marshals of authority to arrest illegal aliens for ICE

WASHINGTON—Yesterday, the Immigration Reform Law Institute (IRLI) filed a brief in the D.C. Circuit Court of Appeals urging reversal of a D.C. federal district court's ruling that U.S. Marshals have no authority to make immigration arrests.

 

The case was brought by an illegal alien who was released on his own recognizance by the magistrate judge hearing his criminal case in a D.C. trial court. At that point, a U.S. Marshal detained him, as requested by Immigration and Customs Enforcement (ICE), until ICE could arrive and assume custody. The judge in the D.C. federal district court the alien later sued in concluded that the Marshal only had authority to maintain the alien in custody, not to initiate custody of him after the magistrate judge had released him.

 

In its brief, IRLI shows that the district court's conclusion is based on an erroneous reading of the statutes and regulations granting wide-ranging law enforcement authority to U.S. Marshals. They not only have the authority to comply with ICE's requests to maintain custody of an alien, but to initiate custody of—that is, to arrest—an alien based on an ICE request for detention. This authority is both delegated to Marshals by the Attorney General and given to Marshals directly by statute. Marshals also have the authority to arrest persons they have probable cause to believe are in the country illegally, even without a request by ICE.

 

"We have all heard of sanctuary cities and states, which unlawfully refuse to cooperate with ICE, but now, according to the district court, even federal law enforcement officers can't cooperate with ICE," said Dale L. Wilcox, executive director and general counsel of IRLI. "We hope the D.C. Circuit sees this activist decision for what it is, and restores Marshals to their full powers to enforce our nation's immigration laws as needed."

 

The case is N.S. v. Dixon, No. 21-5275 (D.C. Circuit).

Donalds Joins Bipartisan Financial Services Committee Letter To The Treasury Department

Congressman Byron Donalds (R-FL) joined the Chairman of the House Financial Services Committee, Patrick McHenry (NC-10), Congressman Ritchie Torres (NY-15), and a bipartisan group of lawmakers in sending a letter to the United States Department of the Treasury (Treasury) urging the agency to revise its proposed implementation of unworkable digital asset tax reporting requirements as enacted in the Infrastructure Investment and Jobs Act (IIJA). The letter was signed by several of the bipartisan cosponsors of the Keep Innovation in America Act, including Congressman Warren Davidson (OH-08), Congressman Eric Swalwell (CA-14), Majority Whip Tom Emmer (MN-06), Congressman Wiley Nickel (NC-13), Congressman French Hill (AR-02), and Congresswoman Erin Houchin (IN-09).

If finalized, the proposed regulations' overly broad definition of a digital asset "Broker," insufficient definition of a "Digital Asset," and unreasonably short comment period threaten to prevent a large swath of the digital asset ecosystem from continuing to exist in the United States.

"We write to you today to express our continued concern with the Department of the Treasury's ('Treasury') treatment of digital assets for tax reporting purposes. While we appreciate Treasury's efforts, the August 25, 2023, proposed regulations (proposed regulations) would inhibit innovation and harm the digital asset ecosystem if finalized in its current form.

"As we have communicated previously, the tax reporting requirements on digital asset market participants in the Infrastructure Investment and Jobs Act (the 'IIJA') are unworkable as written and fail to consider factors that are inherent to the digital asset ecosystem. The proposed regulations do not remedy our previously stated concerns. The breadth of the proposed regulations and the unworkable definitions raise serious concerns for the digital asset ecosystem. Treasury must address the following concerns to ensure the United States has a workable tax reporting framework for digital assets.

"The definition of 'Broker' remains too broad and would capture entities that do not possess traditional characteristics of a broker.

"In the proposed regulations, Treasury defines 'broker' to include persons who provide 'facilitative services that [directly or indirectly] effectuate the sales of digital assets by customers.' This definition captures a significant portion of the entities within the digital asset ecosystem, including decentralized finance ('DeFi') exchanges.

"The definition of 'Digital Asset' fails to consider or differentiate the uses or attributes of different types of digital assets.

"In addition to expanded definition of 'broker,' the proposed regulation includes a definition for 'digital asset' that will limit the use of certain digital assets. Specifically, Treasury's proposed regulations define 'digital asset' as 'a digital representation of value that is recorded on a cryptographically secured distributed ledger (or similar technology)' and explicitly includes 'those referred to as stablecoins or [nonfungible tokens] ('NFTs').'

"The comment period and implementation timeframe for the proposal is unreasonably short.

 "We are concerned with the expedited time frame for both the comment period and implementation phase. The shortened timeframe limits the amount of feedback and the ability to make changes to the final rule. It further strains market participants who will need additional time to come into compliance.

"We appreciate your attention to our concerns. This proposal, as currently written, will prevent a large swath of the digital asset ecosystem from continuing to exist in the United States. We urge you to reevaluate the proposed regulations and adjust them accordingly to ensure there is a workable tax reporting framework in place for the digital asset ecosystem."

WRVA with John Reid on why Sen. Hashmi Must Resign

I am calling on State Senator Ghazala Hashmi to resign over her fraudulent claim of residing at an apartment in North Chesterfield. She has committed election fraud and lied to voters. She must resign.


I am also calling on Republican and Democrat Senate leadership to step up and join me in calling for Sen. Hashmi to resign.


Sen. Hashmi and her husband own a house that they have lived in for about 25 years. Re-districting moved the lines for a lot of state senate districts. Sen. Hashmi's house was drawn into a new district. Virginia law requires state senators to live in the district they represent.


Below is a photo of one of the documents in question, published by The Daily Wire, and here is a link to that one and the rest of her campaign paperwork. Take a good look at lines 4 and 5.


She doesn't live in that apartment, line 4. So she's registered in a place where she doesn't live, line 5. Then take a look at her signature on the form. That's a felony.


I don't know anyone who believes Sen. Hashmi lives alone in North Chesterfield. I seriously doubt even Sen. Scott Surovell believes that. But Scott and his colleagues are going along with Sen. Hashmi's lie; they promoted her to be their caucus treasurer. A known liar handling a lot of money- what could go wrong?


I don't agree with those who say there should be a special election called by the Governor to replace Sen. Hashmi. Two candidates filed in Senate District 15 by the deadline and one is disqualified because she lied about her primary residence.


This cannot stand. We must do something. Please call your State Senator and urge them to pressure Sen. Hashmi to resign and call for a full investigation. Here is the link to the State Senate Directory.


The law applies equally to everyone. The Department of Elections and the Attorney General's office need to investigate, and Republican and Democrat Senate leaders need to join me in calling for Sen. Ghazala Hashmi to resign.

Gary Bauer: About That Pipeline

Do you remember the initial shocking reports in September of 2022 that two major pipelines supplying critical natural gas to Europe were blown up? 


Immediately, we were bombarded by what can only be described as "propaganda," launched by the U.S. government, the media establishment and, frankly, a lot of good people in Congress who believe in a strong national defense.  


"It was obviously Russia," they insisted. "Putin did this so Europe would freeze during the winter. It's energy blackmail," they claimed.


Well, my "BS antenna" went up immediately. Why would Russia blow up its own pipelines, when they could just turn them off? It made absolutely no sense for Putin to destroy a primary source of income, especially since he has simply shut off the spigot before. (Here and here.)


But if you were one of the few voices who said, "Russia blowing up its own pipeline is insane," you were denounced as a "Putin apologist" and a "Russian stooge," and accused of undermining the free people of Ukraine. 


Now, more than two years later, we find out that Ukraine, in fact, did it. 


A major report by the Washington Post and the German media outlet Der Spiegel broke over the weekend. It details how Roman Chervinsky, a colonel in Ukraine's special forces, led a six-person team to destroy the Nord Stream pipelines.


So, the government in Kiev that we're all in with was willing to let Europeans die from exposure to the cold in order to push them into a conflict with Russia.


I bring this up because we have to be discerning, particularly when the war drums are being beaten so hard. 


The rush to Ukraine's side has already cost us more than $100 billion. And there are plenty of reasons to believe that this story isn't the only lie that was pushed on us and Western Europe.

We are marching to free the hostages and to take a stand against the ancient evil of anti-Semitism.  

 

The March For Israel is sponsored by the Jewish Federations of North America and the Conference of Presidents of Major American Jewish Organizations. 

 

Christians United For Israel and American Christian Leaders for Israel are also supporting Tuesday's event.

Congressman Good Update: Thank You to Virginia’s Veterans

This Veterans Day, I want to express my profound gratitude to all veterans and especially recognize the 45,000 who live in Virginia's 5th District. Every year on November 11, we unite as a nation to celebrate and honor all veterans who selflessly put their lives on the line, fighting for the freedoms that make this the greatest country on Earth. Veterans have made considerable sacrifices serving this nation. We must honor them, and ensure they receive the benefits promised for their noble service.

This week I introduced the Veterans Education is Timeless Act of 2023, a bill that would remove arbitrary expiration dates on education benefits for veterans and their families.

Our veterans and their families deserve to have access to the educational benefits promised to them, no matter when they choose to use them. These programs ease the transition to civilian life by providing vital educational assistance to veterans and their families and help them achieve their career and educational goals.

One of my greatest privileges as a congressman is the opportunity to help honor our veterans who did not receive the medals and commendations they earned while serving our country. I presented pins to 14 Vietnam veterans in Louisa this week to honor their sacrifice to our nation.

Bishop E.W. Jackson, Sr.: Pray For Our Veterans

On November 11, we celebrate Veterans Day, to honor all who have served. This is a very important day and we should never forget how special it is.

All who put on the uniform and raise their right hands in an oath to the Constitution offer their lives to defend our country from all enemies, foreign and domestic. Although we serve for a period of years, there is no expiration date on that oath.

At the end of the World War I, the armistice was signed on the eleventh hour of the eleventh day of the eleventh month of 1918 - "Armistice Day." November 11 was to be a celebration, not only of the end of WWI, but the end of all war.

Yet war did not end. World War II erupted 21 years later. Then there was the Korean Conflict, the Vietnam War, and the war on terror. Today we face the possibility of being drawn into the fighting in Ukraine and Israel. While we hate war, we know that it will be necessary as long as there are sinful men and women in this world.

As a Marine Corps veteran, I honor my brothers and sisters who serve. In spite of the lighthearted jostling between the various branches, we respect each other for that service and take very seriously our responsibility to defend our country.

Veterans Day is our opportunity to express our undying gratitude to those who "loved country more than life." Some came home from combat physically and psychologically wounded. Some never came home. We owe them all a debt of thanks that we can never repay.

Pray for our veterans. They face many challenges post military service and a government that is slow to meet their needs. Pray also that those on active duty today will be delivered from the social experimentation inflicted on them in recent years. Instead of being forced into the role of social justice warriors whose highest duty is to take showers with women who want to be men and men who want to be women, may our heroes be set free to do the job they signed up to do.

Those who have served honorably and hung up their uniforms never forget their oath. May our nation never forget them, always honor them, and may God bless them for their service.
