Gary Bauer: Confronting Communist China

A few months ago, we told you that yet another cyberattack by communist Chinese hackers had severely compromised U.S. communication systems, particularly those on the strategically important island of Guam.


Now it's being reported that U.S. intelligence officials are scrambling to identify and remove potential malware that was likely embedded in multiple critical infrastructure systems during that cyberattack. At least one official described the malware as a "ticking time bomb" that could also bring down power grids and water systems.


In addition, NBC News reported late last week that state and federal authorities busted an illegal laboratory connected to a mysterious Chinese company operating in Fresno County, California. 


Among other things, they found more than 20 hazardous and infectious biological agents, including "coronavirus, HIV, hepatitis and herpes." Hundreds of mice were also seized and euthanized.


These incidents underscore yet again that communist China is not a normal country or a benign trading partner. It is an enemy increasingly determined to replace the United States as the world's leading superpower and impose its will on the world.

Imagine that you live in a country where the government censored the news and where national security and intelligence agencies worked to sabotage opposition candidates. 

 

Imagine that you lived in a country where religious activists were prosecuted by the government, and where churches were under government surveillance.

 

Imagine that you lived in a country where the leader believed he could do whatever he wanted – just by the stroke of his pen – without any legal authorization.

 

What I have just described may sound like the old Soviet Union, communist China, or Marxist Venezuela. But I'm not referring to those totalitarian regimes, and we don't have to imagine anything.

Federal Judge Invites A New Surge of Asylum Abuse

(July 25, 2023, Washington, D.C.)  Today's ruling by Federal District Court Judge Jon Tigar effectively negates any impediments to foreign nationals seeking to abuse our nation's asylum laws, and will trigger an even more massive surge of people crossing our borders illegally, charges the Federation for American Immigration Reform (FAIR). 

The Circumvention of Lawful Pathways rule implemented by the Biden administration in May bars some migrants who enter the U.S. between ports of entry from seeking asylum. Today's ruling essentially says that no matter how many people cross the border illegally, regardless of how many countries they may have transited along the way, it has no effect on the availability of asylum which must be available without restriction.

"If Judge Tigar's injunction of the Circumvention of Lawful Pathways rule goes into effect two weeks it will serve as an invitation for people to further abuse our asylum process," commented Dan Stein, president of FAIR. "With Title 42 gone and no mechanism in place to promptly expel even some of the people who enter between ports of entry, a new surge of people crossing illegally could well exceed the records set earlier this year.

"Judge Tigar's ruling threatens even greater chaos, ignoring the real harm that is being done to the nation, based on a specious assertion that the 30-day public comment period was insufficient and 'unreasonable,' for opponents of even minimal immigration enforcement to weigh-in. In fact, what is unreasonable is that communities all across the country are reaching the 'breaking point' trying to cope with the 2.3 million new illegal aliens the Biden administration has already allowed to enter the country," Stein concluded.

Can New Jersey Ban Alien Detention?

IRLI shows full court that state law is unconstitutional

WASHINGTON—The Immigration Reform Law Institute (IRLI) has filed a brief before a New Jersey federal district court in a case challenging a New Jersey law banning private contractors from operating federal alien detention centers in the state. Both in New Jersey and around the country, the federal government relies on private contractors to house aliens who have violated federal law but have elected to stay in the country in detention while fighting their deportation.

 

In its brief, IRLI shows that the New Jersey law is preempted under the Constitution's Supremacy Clause because it intentionally interferes with this federal contracting program, which immigration statutes expressly contemplate, and that no "presumption against preemption" applies because immigration is exclusively an area of federal concern.

 

IRLI also shows that the law discriminates against the federal government, in violation of the immunity doctrine, by allowing privately-run facilities that serve state purposes while banning those that serve federal purposes.

 

In enacting its detention ban, New Jersey followed in the footsteps of California. But last year, at IRLI's urging, the full Ninth Circuit Court of Appeals, sitting en banc, struck down California's ban on private detention.

 

"With this law, New Jersey aims to cripple our nation's immigration law enforcement, which relies so heavily on federal contractors to house detainees," said Dale L. Wilcox, executive director and general counsel of IRLI. "The problem is, the very purpose of this law is what makes it unconstitutional. We hope the court clearly sees this, just as the Ninth Circuit did, and strikes down this law as flagrantly defying the Constitution."

 

The case is CoreCivic, Inc. v. Murphy, No. 3:23-cv-00967 (D.N.J.).

Mr. Woolf, a northern Virginia police detective for more than 15 years was contacted on Tuesday by a Prince William County resident who had recently lost a friend to an opioid overdose.

Gary Bauer: Kirby Goes Crazy

Retired Real Admiral John Kirby is probably the most effective spokesman for the Biden White House. He's certainly much better at the job than White House Press Secretary Karine Jean-Pierre. He's very good at deflecting tough questions and has a very even keeled demeanor.


But I was astonished by his bizarre defense last week of the Pentagon's new pro-abortion policy that subsidizes travel costs for female (and presumably even "male" personnel) seeking abortions.


Kirby said that when our brave sons and daughters enlist in the military, they have every right to expect that the military will take care of them and their families, and that "reproductive [health] care is a foundational sacred obligation of military leaders."


Well, using Pentagon resources to subsidize abortion is a violation of federal law and has been for decades. Our patriotic recruits who volunteer for military service aren't signing up for "free abortions." That's insulting to our troops!


But what really struck me was how passionate the mild-mannered Kirby was about this issue, as he pounded the podium and declared the destruction of innocent babies to be a "sacred obligation."


There was no such passion from Admiral Kirby when 13 brave Americans were brutally murdered at the Kabul airport because of Joe Biden's incompetence. Kirby said the Biden Administration was "proud" of that disastrous retreat, adding, "For all this talk of chaos, I just didn't see it. Not from my perch."

 

There's considerable irony here, too. 


For decades, the political left has accused the American military of being "baby killers." When our soldiers returned from Vietnam, they were advised not to wear their uniforms because they would be attacked and smeared as "baby killers." 


Civilians, tragically, die in any war. And civilized nations go out of their way to avoid civilian casualties and the death of the innocent. 


But leftists are the real "baby killers," who seek to destroy as many innocent pre-born children as possible. Now, under Joe Biden, they are quite literally turning our military into what they falsely accused it of being – "baby killers."

Congressman Good Update: Battling the Biden Agenda

Schools Not Shelters

This week the House of Representatives debated H.R. 3941, the Schools Not Shelters Act. In recent weeks we learned that illegal immigrants are being housed in our public schools as Democrat Mayors in places like New York City no longer have room to accommodate the Biden border invasion.

This is yet another example of how the Biden Administration policy of inviting millions of illegal aliens into our country is turning every state into a border state. Biden and the Democrats are blatantly disregarding our immigration laws and now our children are paying the price.

Schools should be focused on educating our students; instead, they are dealing with the consequences of Biden's open-border policies and trying to house the millions of illegal aliens they let in the country. The Schools Not Shelters Act will prohibit the use of public elementary schools to house to illegal aliens. If we don't let people visit our schools without proper identification, why would we let them live there?

Americans should not have their tax dollars spent on housing illegal aliens in our schools. This bill sends a clear message to the Biden Administration that the safety and education of students should not be compromised for their open border agenda.

Protecting Truckers from Big Government

The ongoing trucker shortage hurts our local farmers and manufacturers' ability to get their products to market, driving up prices for consumers across the country. This week I introduced the Trucking Workforce Improvement Act to repeal a recent Biden regulation on commercial driver's license (CDL) training. This Biden regulation is exacerbating the national trucker shortage and having a negative impact on the economy.

The bill would eliminate the requirement for truckers to complete a newly mandated federal Entry-Level Driver Training (ELDT) course. It would reduce costs and training time, create jobs, and stabilize the trucking industry. This legislation is especially important for small businesses and the agricultural sector.

Government Employees Should Show Up to Work

Every 5 years, Congress authorizes funding for the Federal Aviation Administration (FAA) to ensure the FAA is properly overseeing air travel and safety in the United States. The bill covers rules for aviation safety, funding for airports and air traffic control, improvements to aviation systems, and more.

While debating the FAA bill, I joined Rep. Scott Perry (R-PA) in support of his "Show Up" Amendment, which would require the staff of the FAA to do what most Americans assume that they already do -- show up to work every day. The taxpayers who pay their salaries expect federal bureaucrats to do at least the bare minimum and show up to do their jobs. It's time to end telework for these government workers.

Unfortunately, some Republicans joined with Democrats to defeat the Show Up Amendment, and others my conservative colleagues and I fought for that would eliminate climate and diversity, equity, and inclusion (DEI) initiatives, and reinstate pilots who were unjustly terminated for not receiving the COVID vaccine. Because the bill increased government spending and failed to reverse Biden's harmful policies, I voted against its passage.

Uncovering the Untold Truth: The Real History of COVID Revealed

The pharmaceutical companies, the CDC and the NIH are earning billions from the vaccines. And as I wrote to you previously, it is well known that medical crony capitalist Anthony Fauci has profited untold millions.  

It was many years in the making, and Fauci has been a central figure since the '80s. A brief history lesson of Covid and the vaccine will tell you everything you need to know:

  • In 1965, scientists discovered the coronavirus and began to modify it by studying it in animals.
  • In 1990, Pfizer created the first spiked protein vaccine based on these animal experiments. Pfizer quickly learned the vaccine did not work because the coronavirus was malleable. It modifies and mutates too rapidly for a vaccine to be effective. These findings were cited in many major publications.
  • In 2002, the University of North Carolina, Chapel Hill patented an "infectious replication defective" clone of the coronavirus. In plain speak, "a bioweapon." This patent was based on research funded by Anthony Fauci and only granted after the CDC intervened and pressured the patent office.
  • In 2005, the scientific community labeled the coronavirus a "biowarfare enabling technology."
  • In 2015, a statement from the National Academy of Sciences reveals one of the true objectives of the vaccines: PROFIT.
    • It read: "To sustain the funding base beyond the crisis, we need to increase the public understanding of the need for medical countermeasures, such as the pan-influenza, or pan-coronavirus, vaccine. A key driver is the media, and the economics will follow the hype. We need to use that hype to our advantage to get to the real issue. Investors will respond if they see profit at the end of the process."
  • In 2019, Moderna received a patent for a vaccine that included the statement "for the accidental or intentional release of a respiratory pathogen" - something that did not exist at the time.
  • In 2023, The US Congress discovered an additional and unreported $2 million in research funding to the Wuhan Institute of Virology. This funding was again transferred indirectly through EcoHealth Alliance, Fauci's favorite partner for hiding illegal funding of gain-of-function research.
  • Since 2005, well over $10 billion has been funneled to research institutions at the direction of Fauci and the National Institute of Allergy and Infectious Diseases (NIAID) to ILLEGALLY fund gain-of-function research and the development of the mRNA vaccines.

COVID-19 virus was engineered in a lab. So were the COVID-19 shots – and with patents preceding the virus.

What came first, the chicken or the egg? The manufactured virus or the manufactured treatment? Was the creation of COVID-19 designed to sell a treatment?

This system of manipulation and betrayal from the revolving door of Big Pharma and three-letter government health agencies (NIH, CDC, FDA …) goes beyond brazenly disregarding the health and welfare of the American people … these are crimes against humanity!

IRLI, D.C. Candidate for Mayor Defend Suit to Stop D.C. Alien Voting Law

Shows law violates right of U.S. citizens in the nation's capital to govern themselves

WASHINGTON—On Friday, the Immigration Reform Law Institute (IRLI) filed a response to the D.C. Board of Election's motion to dismiss a lawsuit IRLI has brought against it to bring down a District of Columbia law allowing aliens—including illegal aliens and even foreign diplomats—who reside in the city to vote in municipal elections. In the suit, IRLI represents Stacia Hall, the Republican candidate for D.C. mayor in 2022, and six other U.S. citizen D.C. voters.

 

In its brief, IRLI points out that the extension of the vote from U.S. citizens to aliens automatically dilutes the votes of U.S. citizens. Such vote dilution based on citizenship—harming citizens as it benefits noncitizens—denies citizens the equal protection of the law, if that dilution lacks an adequate justification.

 

No justification for this law can stand against the sovereign interest that all American citizens have in the democratic self-government of their country. As the Supreme Court has held repeatedly, the body politic of this nation consists of its citizens, and the right to govern—and to vote—is "reserved" to them.

 

Indeed, IRLI shows, the fundamental right to citizen self-government is proclaimed in the Constitution's first three words, "We the People." Since the people—that is, citizens—established the Constitution, and the Constitution is "the supreme Law of the Land," citizens must have been—and still are—the sovereign of this country. As such, citizens, as the Supreme Court has put it, have a "right . . . to be governed by their citizen peers," not foreigners.

 

"The sovereign of this democratic nation is the people, U.S. citizens," said Dale L. Wilcox, executive director and general counsel of IRLI. "When their power is eroded, our nation begins to lose its very independence. And that erosion is set to escalate. Already, there have been calls to let aliens vote in statewide elections. We hope the court sees how deeply at variance with the Constitution this law is, and strikes it down to protect our American democracy."

 

The case is Hall, et al., v. DC Board of Elections, No. 1:23-cv-01261 (D.D.C.).

EMET Profoundly Thanks Senator Ted Cruz and 14 of of His Senate Colleagues

We, at EMET, sincerely express our deep gratitude to 15 US Senators, including Senators Ted Cruz (R-TX), Marco Rubio (R-FL), John Cornyn  (R-TX), Lindsey Graham (R-SC), Rick Scott (R-FL), Bill Hagerty  (R-TN), Ted Budd (R-NC), Pete Ricketts (R-NE), Tim Scott, (R-SC)Tom Cotton (R-AR), Marsha Blackburn (R-TN), Mike Braun, (R-IN), John Barrasso (R-WY), Jim Risch (R-ID), and Roger Wicker, (R-MS) who had written to President Joe Biden and Secretary of State Antony Blinken on July 11th  about discriminatory practices against the state of Israel.


In it, the Senators write: "The guidance does something America has never done before unilaterally impose territorial restrictions on U.S. scientific research aid to Israel. Decades ago, the U.S. and Israel bilaterally agreed to such limits against the backdrop of unique regional conditions, but in 2020, both sides rescinded and rejected them as discriminatory."


The letter comes about as a result of "guidance" for our US agencies to halt any scientific funding or collaborative research between the United States and Israel, if the institutions are based in Judea and Samaria, (the "West Bank"), East Jerusalem, or the Golan Heights. These territories had been captured in Israel's defensive war of 1967. The letter also calls out the administration for not informing Congress about this, and for the fact that they had to learn about this through journalists.


The letter also states that this "guidance", as written, "constitutes an antisemitic boycott against Israel". It goes on to state "The American people and Congress broadly and deeply oppose boycott efforts against Israel, which have been repeatedly defined in U.S. law as efforts to limit commercial with persons doing business in any territories controlled by Israel (see, e.g., 19 USC § 4452(f)(1) and 19 USC § 4201(b)(20)). It goes on to state that according to the International Holocaust Remembrance Alliance working  definition of antisemitism, this policy holds Israel to a "double standard", which is one long-held example of antisemitism.


Many of these institutions are deeply engaged in medical, scientific, and technological endeavors that not only serve to benefit all of humanity but also employ thousands of Israeli Jews, Palestinians, and Israeli Arabs. As the letter states, "This guidance, in particular, puts Americans' safety, security, and prosperity at risk because it politicizes and undermines cooperation on science and technology, including in areas such as defense and medicine where also our Israeli allies have proven themselves critical partners. It vitiates the neutral, objective criteria that relevant organizations are required by their charters and the law to use when evaluating grants, and potentially force them to act illegally – broadly endangering their ability to continue funding such research on behalf of Americans and Israelis."

This decision had been in effect prior to the previous administration but was reversed by the Trump White House. The letter calls upon the administration to "rescind this discriminatory guidance", and it emphasizes that "any effort to deepen American policies that discriminate between territories Israel controlled before and after June 1967 will risk a full rupture in my/our ability to engage the Department of State on these issues." It goes on to state that "Candidly, it is untenable for State Department officials to continue testifying to Congress that they support the U.S.-Israel relationship and then – once out of view – to push policies designed to undermine that relationship. Without a reversal in these trends, Congressional oversight and the expeditious vetting of nominees would become intractable."

The failure of the State Department to honestly and objectively examine whether or not this paradigm is working indicates a total deficiency of creativity  imagination, intellectual honesty, and objectivity."

Congressman Good Update: Supporting our Men and Women in Uniform


This week, the House debated and passed the National Defense Authorization Act (NDAA). The NDAA establishes the military's spending priorities and policies for the upcoming fiscal year. The American people deserve the world's strongest military which is equipped and ready to protect our country. It is Congress' constitutional duty to focus on funding a lethal fighting force while also working to rein in wasteful spending at the Pentagon

This year's defense bill would end the paid abortion travel policy at the Department of Defense and block taxpayer funded transgender surgeries. The bill defunds climate programs and so-called "DEI" programs. The legislation also includes a first step toward reinstatement of men and women who were wrongfully discharged under the vaccine mandate.

I filed four amendments to the NDAA: to stop taxpayer funding for the CCP, to provide local police departments with access to needed surplus military equipment, to reverse the decisions of the anti-American history Naming Commission, and to ban high ranking military personnel like Mark Milley from lobbying the federal government until ten years after retirement. I was proud that my amendments to provide our police with surplus military equipment and to ensure no taxpayer money goes to the CCP were adopted and included in this legislation.

This NDAA represents a significant improvement over the radical agenda in the Democrat versions from the past two years. The House Leadership must now demonstrate unprecedented strength and resolve in negotiations with the Senate.

Ending Special Treatment for the NEA

The National Education Association (NEA) may have been started with good intentions, when Congress created it in 1906 "to elevate the character and advance the interests of the profession of teaching." However, it has increasingly become an extension of the Democrat Party. In the 2020 election cycle, nearly all of its more than $100 million in campaign contributions went to Democrat candidates. In 2020 and 2021, the NEA fought against the reopening of schools by threatening strikes and influencing CDC guidance advising against a return to in-person learning.

The NEA long ago departed from its core mission and instead pushes a woke agenda. At a 2019 conference, members voted in support of the right to abortion, illegal immigrant justice, and student Gender Sexuality Alliance clubs. In July 2021, the NEA adopted measures supporting critical race theory (CRT). The NEA also provides resources to teachers on how to defy state laws that limit teaching on CRT and sexually explicit content, and actively supports sexualized books for summer reading.

That's why I just introduced the National Education Association Charter Repeal Act, which effectively revokes the NEA's congressional "seal of approval" and eliminates the organization's special property tax exempt status.

Congress must do more to fight for America's parents and children, and I am proud to sponsor this legislation.

Bringing Transparency to Healthcare Costs

Healthcare costs are a top issue for Americans struggling under the high cost of "Bidenomics." We need a healthcare market that works for all Americans, not a government-run socialized medicine scheme.

As HELP Subcommittee Chairman, I am working to identify reforms that will helpfix our healthcare system by increasing transparency and reducing costs. That is why I introduced the bipartisan Transparency in Coverage Act, which passed the House Committee on Education and the Workforce this week. My legislation will bring more transparency to healthcare pricing by requiring accurate and timely disclosure by health insurance providers and Pharmacy Benefit Managers (PBMs).

Curious Changes

In mid-May, the Department of Justice radically changed its website and erased significant amounts of content related to the sex trafficking of minors. Whole sections devoted to domestic and international sex trafficking of minors disappeared. 


Here's one section on the grooming of victims that was removed:


"After cultivating a relationship with the child and engendering a false sense of trust, the trafficker will begin engaging the child in prostitution, and use physical, emotional, and psychological abuse to keep the child trapped in a life of prostitution.

 

"It is common for traffickers to isolate victims by moving them far away from friends and family, altering their physical appearances, or continuously moving them to new locations. Victims are heavily conditioned to remain loyal to the trafficker and to distrust law enforcement."


Kudos to Natalie Winters of the War Room for exposing these curious changes.


I'm sure if anyone asked the Biden Justice Department why these changes were made, they'd offer some lame excuse about making the site more efficient. Call me skeptical. 


Let's not forget the grooming that's going on in our schools by the LGBTQ mafia and the Biden Administration, as well as the sex trafficking problem that Biden's open border policies are enabling at the southern border.


The Trump Administration went to great lengths to ensure that adults coming across our border with children were in fact related to the children. Trump officials understood how children were being exploited. But Biden scrapped all those precautions and safeguards.


Why? The best possible spin is that they're desperate to empty the detention centers as quickly as possible so the border crisis doesn't look as bad as it is. 


Fox News host Rachel Campos-Duffy ripped the Biden Administration for making the U.S. government "complicit in child sex trafficking and slavery." Sadly, she's right.
