IRLI shows appellate court that refusing to enforce the law is not an option

WASHINGTON—Today, the Immigration Reform Law Institute (IRLI) filed a friend-of-the-court brief in the Sixth Circuit Court of Appeals urging that court to affirm an Ohio federal district court's grant of a preliminary injunction, sought by Arizona, Montana, and Ohio, against the Biden administration policy of detaining and removing far fewer criminal aliens than had the previous administration.

In its brief, IRLI shows that the language Congress used when it directed that criminal aliens be detained and removed from the country is mandatory, leaving no discretion to the executive to exempt and release the great majority of these aliens, as the administration has done.

As IRLI explains, it is Congress that makes the laws, and the executive that is supposed to carry them out—not make its own laws opposed to those of Congress.

"There is a good reason the law says so clearly that aliens who turn out to be criminals should be removed," said Dale L. Wilcox, executive director and general counsel of IRLI. "Many of them Biden has let go are dangerous, and Americans' safety is very much at stake. We applaud the court below for reading the law the only way it can be read, and hope the Sixth Circuit affirms that judgment."

The case is Arizona v. Biden, No. 22-3272  (Sixth Circuit).

Joe Biden let the cat out of the bag yesterday. He was asked by a reporter about skyrocketing gas prices, which are setting new records almost every day. The president replied, "We're going through an incredible transition. . . When it's over . . . we'll be less reliant on fossil fuels." 

An "incredible transition"? I think he's enjoying this misery. Clearly, Joe Biden is not feeling your pain at the pump. 

Here's what you need to help your friends and family members understand: Biden doesn't care about your pain at the pump because he's causing it!

Your pain at the pump is all part of the left's plan. But don't take my word for it. The left has been very clear about its radical agenda.

  • Barack Obama said he wanted to bankrupt the coal industry. 

  • Obama's energy secretary said they wanted gas to be $10 a gallon.


  • Joe Biden said he wanted to "transition away" from the oil and gas industry. 

So, the first thing he did after taking office was to cancel the Keystone XL pipeline. He's choking off future supply of oil and natural gas by banning new domestic energy exploration.

His appointees (here and here) are demanding that we bankrupt our energy companies in the name of "climate change." And they want to impose carbon taxes and "social costs" to energy, making it more expensive and forcing you to change the way you live.

So, how is Biden's "incredible transition" going for you? 

By the way, it doesn't stop with you and your car. Biden wants our military to drive electric "climate-friendly" tanks, too! Exactly where on the battlefield are we supposed to plug in our tanks?

If our auto fleet is all electric in a few years, how do you get to the hospital or to the grocery store after a hurricane or some other major disaster knocks out the electricity, not for hours, but days or weeks?

And why would we do one more thing that empowers communist China, which has cornered the market on the rare earth minerals needed to mass produce electric vehicles?

This idiocy is driving everything the Biden Administration does!

Bryce Reeves - Working for our Soldiers and Veterans: In Virginia and Across the Nation

We've been working hard to affect change for our veterans and active duty soldiers and I wanted to give you a quick update on everything that is going on. At the end of last week, I was out on the west coast for a meeting of the National Conference of State Legislators Military and Veterans Task Force, where I am Co-Chairman. Some of our bigger focuses were on strengthening the National Guard's recruitment, resiliency, and retainment. On the national level, we tackled combatting veterans suicide and how we can facilitate better awareness and mental health treatment at the state level.
 
On Friday, we spent the day at Naval Base Kitsap. Our Task Force is also working on the DoD's REPI program, and making sure state and local governments are working towards meeting the guidelines outlined. These goals involve lifting restrictions and dealing with land use issues, so that our soldiers have places to train and are better equipped to keep us safe. President Reagan's "Peace through Strength" continues to ring true - the better prepared our military is, the less we will need to use it.

While the national effort with NCSL is helping active duty soldiers and veterans across the country, we also had some big wins at home in Virginia this week. Governor Youngkin signed two of my bills into law on Friday - SB529 and SB768. SB768 amends the definition of "qualified survivors and dependents" under the Virginia Military Survivors and Dependents Education Program (VMSDEP) to include that a child who is a stepchild of a deceased military service member shall receive all Program benefits. The VMSDEP is a key recruiting tool to entice veterans to remain in Virginia. It provides tuition and fee waivers for veterans with severe disabilities and for families of military members who died on active duty. Unfortunately, the reality of the modern "blended family" is such that some veterans may have been the step-parent of a child since birth but never legally adopted the child. Senate Bill 768 fixes this issue. I was thrilled to work with my colleagues in the General Assembly, and Governor Youngkin, to get this bill passed unanimously and solve this problem.
 
SB529 was another big win for our active duty members. The Pentagon has been highlighting how important it is, operationally, for consistent and affordable child care for active duty service members. This bill is a massive first step in easing access to child care for all active duty members in our Commonwealth.

Stop the ambiguity about – and US underwriting of – Chinese aggression

President Biden today explicitly declared that the United States would defend Taiwan in the event it is attacked by Communist China. As has happened before, however, the White House promptly walked back that statement, reestablishing the sort of official "strategic ambiguity" that at this point can only invite such Chinese aggression.

An even further inducement to the Chinese Communist Party's belligerence is a move afoot in Washington and on Wall Street that would result in U.S. military personnel and other federal government employees helping pay for it. The Federal Retirement Thrift Investment Board is holding a public meeting tomorrow morning and – all other things being equal – it is expected to greenlight the investment of their Thrift Savings Plan accounts in mutual funds that will include CCP companies, even sanctioned ones.

Congressman Bob Good: Concerning the World Health Organization (WHO) and its response to the COVID-19 virus.

As you know, the World Health Organization (WHO) is a United Nations agency that focuses on addressing health globally. Evidence suggests that the WHO backed the Chinese Community Party (CCP) in regurgitating lies and withholding information about COVID-19. This organization claims to be neutral but has too often simply copied and pasted the CCP's talking points about the virus. 

The United States has been a significant financial contributor to the WHO, providing roughly $262 million each year between 2012 and 2019. The Trump Administration rightly criticized the WHO due to its failure to respond effectively to coronavirus reports and for its favoritism towards China, and subsequently announced the decision to withdraw our funding in April 2020. Following this action, the Trump Administration announced the United States would end its affiliation with the organization altogether. Sadly, President Biden rejoined the WHO in January 2021 in yet another example of his "America Last" foreign policy. 

Recently, the Biden Administration proposed amendments to the International Health Regulations treaty. This is a purported attempt to achieve greater cooperation in sharing information related to public health emergencies after China's lack of transparency during the outbreak of COVID-19. These administrative amendments would strongly encourage member nations to voluntarily communicate additional and more timely information with the WHO during times of pandemic and disease outbreak. The amendments would allow the WHO to determine that there is a public health emergency over the objection of the country where the outbreak originated, and there is no guarantee that the WHO would not side with the Communist Chinese again in the future to the detriment of the rest of the world. 

Continuing to fund the WHO's mission puts America's interests last, and supports the advancement of globalism. The Trump Administration was absolutely correct in withdrawing the United States from the WHO and ending our taxpayer contributions to it. For this reason, I cosponsored H.R.419, No Taxpayer Funding for the World Health Organization which was introduced by Rep. Chip Roy (R-TX). This bill would prohibit the United States from providing one more penny to the WHO.

Friends, last week I visited the Stafford airport. I toured the facility, saw the expansion of the runway and learned how the airport serves the community. I'm excited to share that once the runway expansion is completed, there will be more air traffic through that airport, bringing more economic activity to the area. Lake many other industries, the airline industry is having a hard time with staffing, specifically regarding the recruitment and retention of pilots. Issues like this are why it is so important that we cultivate a business-friendly environment in Virginia through conservative policy.
 
I also attended the Fredericksburg Area Association of Realtors and Fredericksburg Regional Chamber of Commerce Legislative Reception and talked about the wins of this past session and cast a vision going forward that focuses on strengthening the economy and prioritizing the cultivation of our small businesses.

Small Business Revitalization Tour Continues
 
We are re-launching the small business revitalization tour that we began earlier this year.
 
Every week I will be meeting with a small business owner to talk with them about their successes and struggles, particularly as we still economically recover from the pandemic and the overreaching governmental restrictions that were put in place as a response to the pandemic. The small business revitalization tour will continue providing me with the tools I need to go back to Richmond and win the argument on policy, convincing the Democrats that these folks need reform through eased regulatory and tax burdens.
 
For that reason, I am looking to connect with local business owners to learn how I can best support them and hear their suggestions and concerns related to regulatory and tax policy. Small business revitalization is a key priority of mine, and there is no better way to advance their interests than to meet with the owners firsthand.

FAIR Applauds Preliminary Injunction against Lifting Title 42

Ruling Will Partially 'Restrain' the Biden Effort to End All Border Enforcement

The following statement was issued by Dan Stein, president of the Federation for American Immigration Reform (FAIR) in response to a preliminary injunction blocking the Biden administration's plan to cancel Title 42, effective Monday:

"The Federation for American Immigration Reform (FAIR) applauds Judge Robert R. Summerhays' preliminary injunction ruling blocking the Biden administration from lifting Title 42, the only remaining mechanism for controlling our southern border.

"In its 16 months in power, the Biden administration has consciously created an unprecedented surge of illegal migration with Title 42 serving as the last constraint on its plan to completely abandon enforcement of our border. By the Department of Homeland Security's own reckoning, their decision to cancel Title 42 would have led to at least an immediate doubling of April's record number of illegal entries, all of whom they planned to quickly process and disperse around the country.

"Judge Summerhays' ruling may prevent the crisis from becoming exponentially worse, but it is not a solution to the problem the Biden administration is deliberately inflicting on the American public. The ball is now in Congress' court, which has the power to hold this rogue administration accountable for its ongoing refusal to carry out its constitutional obligation to enforce our nation's immigration laws."

The Left Targets You

Wednesday night, the House of Representatives rammed through a disturbing bill under the guise of "fighting domestic terrorism." 

The legislation would massively expand the federal bureaucracy by creating new domestic terrorism units inside in the FBI, the Department of Justice and the Department of Homeland Security, laying the foundation for a domestic police state.

Gee, what could possibly go wrong?

A lot, as we have just seen with Biden's "Ministry of Truth" at the Department of Homeland Security. That board, initially run by the "Mary Poppins of Disinformation," has been squelched temporarily, but it and other agencies like it would be put on steroids under the bill that passed the House Wednesday night. 

Everything in this bill is meant to spy on Americans. It's aimed at you!

Nothing is being done to stop the carnage that occurs every weekend in Chicago. But once again, the left is doing everything it can to exploit the Buffalo shooting. The major thrust of this "domestic terrorism" legislation is that "hate speech leads to violence." 

Nobody supports domestic terrorism. And if we were following the normal meaning of words, the vote would have been unanimous. 

But the insane left, which believes men can get pregnant and have abortions, is not following the normal meaning of words anymore. That's why virtually every House Republican, including some who had initially co-sponsored the legislation, voted against it. (Only retiring NeverTrumper Adam Kinzinger supported it.) 

Rep. Jim Jordan summed up the problem well. He said:
 
"This bill is dangerous because we've already seen the weaponization of the government. We saw it in the IRS a few years ago. We've seen it in the FBI . . . most recently, the DOJ working with the FBI to go after parents. This bill formalizes what we've already seen. That's why it's so dangerous." 
 


The Criminalization Of Politics

This legislation is yet another part of the left's ongoing effort to criminalize politics, to make normal conservative opinions unspeakable.

If you're against the invasion occurring at the southern border, if you believe some of the illegal aliens coming in are criminals, or might take jobs from American citizens of all races, the left says you are engaging in hate speech against foreigners. 

If you believe abortion is murder, the left says that is hate speech against women. 

If you believe marriage is between a man and a woman, the left says you are engaged in homophobic hate speech. The list goes on and on and it's growing by the day. 

Here's the latest example: In an increasing number of schools, left-wing bureaucrats insist that if little Johnny calls someone by the wrong pronoun, that's an assault and hate speech, and Johnny can be thrown out of school.

We've already seen how parents going to school board meetings were targeted by the FBI as "domestic terrorists." 

For years, we've been encouraging more civic engagement at the local level. But when parents show up to complain about the garbage the radical left is pushing on our kids, the left deploys Big Government to shut us up.

The left isn't even pretending to go after "Russian disinformation" any more. It's all about "domestic terrorism" now. And of course, the left is very selective about "hate crimes." It only goes one way.

Concerned parents at school boards are "domestic terrorists," but thousands of looters and rioters are "social justice activists." 


Victory in 10th Congressional District Republican Primary

Good Keeps His Promises. Wins Convention Convincingly

Farmville, VA – Congressman Bob Good today overwhelmingly defeated his opponent in the 5th District Convention held at Hampden-Sydney University with 84.45% of the delegate votes.

"I want to thank the delegates from across the 5th District who came to Farmville and took on the responsibility of electing their Republican nominee for Congress. I am humbled and honored that they have once again placed their trust in me to fight for their values in Washington. They sent a message loud and clear. They want someone who will never back down from the battle for the future of this great country," said Congressman Good.

Good is running for his second term in the United States House of Representatives after winning the seat in 2020.

"When I first decided to run for this seat three years ago, I said the three biggest issues I saw were illegal immigration and border security, spending and our massive national debt, and the indoctrination of our children rather than education. Little did I know at the time that our rights would be trampled on by government in the name of the China virus. Government tried to take away our freedom of religion, our freedom of assembly, our freedom to open our businesses, and our freedom over our own health care choices," Good continued.

Since arriving in Congress, Good has introduced 31 pieces of legislation to address issues from lockdowns, to life, to the Second Amendment, to freedom in education, to a balanced budget plan. Good and his office have also helped more than 2,000 Virginians cut through bureaucratic red tape.

"From day one, I made serving my constituents a priority. We didn't just wait for people to call us. I sent my team out to every county across the 5th District each and every month, so the people would not have to drive far to see us and get help. So far, we have helped our constituents recover over $9.5 million that was owed to them from the IRS, VA, Small Business Administration, Social Security, and many more federal agencies," said Good.

While a majority of the 5th District remains the same, the new maps added Good's hometown of Lynchburg as well as new counties in the east near Richmond.
"What the delegates, both new and old, ultimately knew is that I am going to be a representative who demonstrates courage each and every day. I will do exactly what I said I would do, and I will fight for them and for their values. And, I am ready to battle the Democrats this fall and win in November," said Good.

Democrats spent more than $11 million in an ill-fated attempt to defeat Good in 2020.
"The Democrats control every lever of power in Washington. As a result of their policies, the cost of everything, from gas, to groceries, to rent is through the roof. There are shortages on shelves, including needs like baby formula. Our border is being overrun and drugs and criminals are flowing in. Our communities are getting less safe. Our freedoms are under attack," Good continued. "I believe voters are going to give Republicans a chance to control Congress and stop the Biden agenda in its tracks. We must rise to that challenge, and do what we say we are going to do."

Good continued, "My Democrat opponent, on the other hand, would be nothing more than a rubber stamp on the Biden-Pelosi agenda. In fact, his number one issue is climate change. In other words, he would be fighting every day to make gas and other energy costs skyrocket. I am confident the people of the 5th District will reject that message."
