New York Congresswoman Claudia Tenney is an attorney and small business owner who has first-hand experience with liberal partisan gerrymandering and interference in ballot integrity in her district at the hands of the left's chief election disrupter, the George Soros-funded Democrat attorney Marc Elias.

Rep. Tenney's district has also been targeted by "Zuckerbucks." Adamantly opposed to any attempts by liberals to federalize elections, Rep. Tenney founded the House Election Integrity Caucus — designed to both inform voters about the falsehoods and disinformation about election legislation pushed by Democrats in this Congress and their far-left allies, as well as to advocate for narrowly tailored legislation such as the "End Zuckerbucks Act" which would end tax-deductibility of private funds such as those used in 2020 to turn election offices into Democratic turnout machines.

The Democrats and their leftwing zealot allies are in a lather because citizens are becoming engaged in the election process in their local areas, across the country. As they did in Virginia in 2021, citizens are realizing that their presence is necessary in the election offices – not just during voting, as watchers, but every day, throughout the year: attending election board meetings, researching what's going on in the election offices, learning how elections are conducted in their home areas. This is a top priority of CPI's Election Integrity Network, which I chair. It is why we have published the Citizens Guide to Building an Election Integrity Infrastructure, which can be downloaded from this website. Citizens Guide - Election Integrity Network

Hi all,

ZUCKERBUCKS BILL - SB80

Senator Bill Stanley's bill to prohibit the private financing of elections moved forward on Friday.  A substitute passed committee and was engrossed by the Senate (i.e., printed for final vote).

From Middle Resolution:

An election bill that our Virginia Fair Elections Coalition is backing is being patroned by Senator Bill Stanley....  SB80 seeks to eliminate the private funding of elections in Virginia. The Center for Tech and Civic Life, exclusively funded by Facebook's Mark Zuckerberg, granted $3.7 million dollars to 38 counties or cities in Virginia in 2020. Inserting funding from Zuckerberg into Virginia's election is disconcerting at best. Private funding of elections only leads to a continued mistrust of public elections and a concern that our elections are not truly free nor fair....

One criticism of the bill is that it only prevents elections officials from taking private grant money.  In contrast, a Zuckerbucks bill in Kentucky extends to all government officials.  orig_bill.pdf (ky.gov)

IT'S NOT OVER IN CONGRESS
Update on election fraud bills in the U.S. Congress from Liberty Counsel Action:

From Amber Haskew:

HR 5746 - Freedom to Vote: John R. Lewis Act will give U.S. Senate candidates up to 1.8 billion dollars of matching government reelection funds for their campaign. To put this into perspective, if senators spend 5 million dollars per day, it would take them a year (360 days) to spend this new government money coming into their campaign! At the same time, Sens. Manchin and Sinema are under incredible funding pressure and attacks from inside their own party. We cannot dismiss the possibility this bill still has of passing.

Behind the scenes, I believe Democrats are continuing to push for this bill. One reason is that when it was clear that the most recent vote would fail, Democrat Senate Majority Leaders Chuck Schumer flipped his vote to AGAINST this bill. This parliamentarian trick keeps this bill alive and allows him to bring it up at any time in the future.

In addition, at any point if radicals can find a moment (even at 4 AM) that Republicans are not on the U.S. Senate floor, they can pass HR 5746 (and many other wish-list items) with a simple unanimous voice vote of those present. Our staff on Capitol Hill have been asking, and continue to urge, our Senators to take shifts so that while gaveled into session the Senate floor is never empty of Republicans. It will take vigilance to monitor both of these attacks at the federal level.

If you wish, we have a petition available to those who wish to oppose this federal takeover of elections to senators here:  https://lcaction.org/LCAemail/elca2102-pet-eip

Text of the latest version of the bill: https://www.congress.gov/bill/117th-congress/house-bill/5746

Summary of the bill (HR 5746):

·       Force states to automatically register people as voters.

·       Require online and same-day voter registration.

·       Ban photo ID.

·       Demand early voting at least 15 days before Election Day.

·       Create federal approval for congressional redistricting plans that assess and prioritize voters by race.

·       Prohibit any attempt to verify a person's eligibility to vote

·       For any gift over 200 dollars, the government will match this with 6 dollars for every 1 dollar for presidential and congressional election campaigns.

·       It would create a public financing voucher pilot program in three states, under which each eligible voter could donate 25 dollars in public funding credit to House candidates.

·       Force states to allow food and nonalcoholic beverages at polling locations, even if it includes candidate logos and branding.

·       Expose private information from large campaign donors.

·       Effectively restore preclearance requirements giving the Department of Justice final control over every precinct and polling place.

·       Give the DOJ federal authority to assign election observers to watch everything inside the precinct and demand "compliance" with the DOJ's politically biased views of voting according to their buddies on the Democrat National Committee.

·       Require states and localities to review and identify any practices that could impact the ability to vote based on race, color or language minority group and submit to the DOJ.

·       And so, so much more!

EARLY WARNINGS

The Republican Plot to Steal the Presidency

The Third Way - a group billing itself as 'center-left' - is pushing the idea the GOP is out to steal the 2024 election.  Senators Joe Machin and Kyrsten Sinema are among the honorary co-chairs.   In short, the Republicans are suppressing the vote, installing 'Big Lie' vote counters (i.e., getting more Republican election workers and poll watchers), threatening election officials, 'seizing' legislative control, and sabotaging the electoral college.  The complete presentation (41 slides) is on the website.

Prosecutors in multiple states are investigating false Electoral College submissions

NPR story:

During the chaotic two months following the 2020 presidential election, groups of Republicans in seven states won by Joe Biden met and signed documents falsely asserting that Donald Trump was or may be the rightful recipient of their state's Electoral College votes.

The efforts, which in many cases seem to have been coordinated by high-ranking members of Trump's campaign team, weren't successful. Congress did not accept any of the illegitimate results on Jan. 6, 2021.

But the actions by those groups across the U.S. still may have been illegal.

Attorneys general in at least two of the seven states where the Republicans met, Michigan and New Mexico, say they have referred investigations regarding the separate slates of electors up the ladder to federal prosecutors.....

Trouble Ahead - Summary of the Gateway Pundit Series on ERIC

Synopsis of:
"Who's "Cleaning" Our Voter Rolls? Soros Founded and Funded ERIC Is Now Used In 31 States"
By Jim Hoft
Gateway Pundit https://www.thegatewaypundit.com/2022/01/cleaning-voter-rolls-soros-founded-funded-eric-now-used-31-states/

*in 2012 the Electronic Registration Information Center (ERIC) was formed as a membership organization primarily for blue States. ERIC is essentially a left wing voter registration drive disguised as voter roll clean up
*The ERIC database is comprehensive and would be one of the most coveted by bad actors looking to influence an election.
*What's odd, and seemingly corrupt, is that ERIC does NOT want to know who is voting illegally.
*Member States are currently using ERIC to hide their list maintenance data, citing it violates their ERIC contracts, even though Federal law mandates it be made public.
*ERIC was funded by an "anonymous" donor and The Pew Center On The States. This grant was provided by the George Soros Open Society.
*The Left activists sued Cross Check (a competing voter registering database) participant States, particularly Indiana, and got court orders to basically shut down Cross Check.
*Soros funded the Brennan Center for Justice and the Advancement Project. These two groups became the loudest voices in opposing election integrity and STOPPING any effort that would ensure only U.S. citizens vote.

Synopsis of:
"ERIC Investigation, Part 2: The Largest U.S. Counties Removed Only ZERO to TWO Ineligible Voters From Their Voter Rolls the Last 4 Years"
By Jim Hoft
https://www.thegatewaypundit.com/2022/01/eric-investigation-part-2-largest-u-s-counties-removed-zero-two-ineligible-voters-voter-rolls-4-years/

*ERIC database looks to be as corrupt as we feared. Over the past four years, the largest US Counties have removed ZERO ineligible voters from their voter rolls.
*States are required by federal law (1993 NVRA) to report to Congress how many ineligible voters they removed from their voter rolls.
*10% of Americans move every year. Those counties should generate hundreds of thousands of canceled registrations. There is simply no way to comply with federal law while removing so few outdated registrations
*Judicial Watch sent warning letters to election officials in several states pointing out these impossibly low numbers of corrected voter registration records.
*The NVRA requires states to "conduct a general program that makes a reasonable effort to remove the names of ineligible voters" by reason of death or change of address.
*Judicial Watch continues to sue the states non-complying with NVRA requirements.

Synopsys of:
"ERIC Investigation, Part 3: Soros Open Society and the Founding of the Nation's Largest Voter Roll Clean-Up Operation"
by Jim Hoft
https://www.thegatewaypundit.com/2022/01/eric-investigation-part-3-soros-open-society-founding-nations-largest-voter-roll-clean-operation/

*ERIC was created by the left-leaning activists and politicians and became an instrument of centralized control over the elections.
*In 2020 Judicial Watch found 29 states had huge registration excesses. In 8 states, if you combined all counties, their average registration for the entire State exceeded 100%. Seven of the 8 are long time members of ERIC (Alaska, Colorado, Maine, Maryland, Michigan, Rhode Island, and Vermont).
*Colorado, a huge proponent and also an 8 year member of ERIC, had 40 of 64 counties exceeding 100%. They were sued by Judicial Watch for this election fraud.
*The organization is extremely partisan left-wing, and funded by the usual suspects indeed.

Best wishes,

Audit update!

That's right, there are a few unanswered questions left from the Maricopa Audit. The Maricopa Board of Supervisors didn't want to comply with several court orders.

Well, here we go!

I'm Arizona Senator Wendy Rogers, the nation's foremost advocate of audits with an audit update! I am calling for the decertification of electors in stolen states- and now we need your help!
This was one of the last pieces- and one even President Trump himself asked us to pursue. The Freedom Times has the story:

Arizona State Senator Wendy Rogers (R) on Friday released an update involving the "Splunk logs and routers", in regards to an agreement that was reached last year in September between the Maricopa County Board of Supervisors and the Arizona State Senate — after the county failed to comply with a subpoena related to the 2020 election audit.

Arizona Senate President Karen Fann (R) had initially sought ballot envelopes or ballot envelope images; user names, passwords, and security keys for election machines; voter records; routers or router images; and Splunk logs, as previously reported by The Freedom Times. Maricopa County officials, however, resisted the Senate subpoena, which then sparked an investigation by Arizona Attorney General Mark Brnovich.

Senate President Fann released a statement in September, indicating that Maricopa County reached a settlement with the Arizona Senate, where they agreed to the initial demands of the subpoena.

According to a new update shared on Friday by Senator Wendy Rogers, former Congressman John Shadegg (R-AZ), who is serving as the Special Master in the settlement agreement, has released the names of the computer experts who will examine the County's routers and Splunk logs. The experts who will work with the Special Master to answer the questions are Jane Gin, Brad E. Rhodes, and Andrew Keck.

"As agreed, by the parties, the examination of the routers and Splunk logs is for the purpose of answering questions posed by the Senate related to the November 3, 2020, General Election during the time between October 7 and November 20, 2020," the statement read.

Finally! It's about time Maricopa turned over the splunk logs. Now it's time to examine them to see if they were tampered with- and get one step closer to the truth about 2020 in Arizona.
I am relentless in my pursuit of the truth. The 2020 election was stolen, and we all saw it. Now we are getting to the bottom of it.

But boy, the Left and their stooges in the media sure don't like me much for pressing on. The ADL called me the worst person in the world or something.

Me, a mere State Senator???

They are so afraid of the truth, it makes them crazy. They think boys can be girls, they think you need a medical record to buy food, and they think 2020 was an "honest" election.

Garbage, as usual.

Help me push to correct the injustice of the 2020 election. Let's find some truths that will REALLY make them crazy!

I am active in all swing 2020 states with audits and election integrity measures. We are making real progress!

We are suffering, America is hurting, because of the mistake that was 2020. Help me fight for the truth and decertify 2020!

Thank you so much,

"For too long Virginians have been at the mercy of the radical left who are weakening our nation under the leadership of Joe Biden and Nancy Pelosi. Liberals in Washington have created record inflation, blatant attacks on law enforcement, open borders, and an education system defined by division and their racist Critical Race Theory agenda. It's time for new leadership that won't bow to special interests and will stand up for every day Virginians who want to raise their families without the heavy hand of government hovering over their heads. Lack of Immigration Enforcement Claims Another Life

January 27, 2022

IRLI investigation sheds light on a deadly traffic stop in Texas

WASHINGTON—As political leaders in Washington continue to undermine America's border security, evidence is mounting that lack of immigration enforcement is costing innocent lives.

This was evident when an investigation by the Immigration Reform Law Institute (IRLI) first discovered the details when a law enforcement officer was allegedly killed recently in the line of duty in the Houston, Texas area by a criminal illegal alien.

In the early morning hours of Sunday, January 23, Harris County Constable's Office Corporal Charles Galloway, 47, attempted to pull over a white Toyota Avalon in what was described as a routine traffic stop. The motorist was Oscar Rosales, a 51-year-old Salvadoran national.

Instead of complying with Galloway, Rosales immediately exited that vehicle and began shooting multiple times with an assault-type rifle at Galloway and then drove away, according to the Harris County Constable's office. This was captured on Galloway's dashcam video. IRLI was the first to confirm that Rosales was living in the United States illegally.

Law enforcement officers and paramedics arrived shortly after, but Galloway, a 12-year veteran of the constable's office, was pronounced dead at the scene. A $60,000 reward was posted for the arrest of Rosales.

IRLI also independently confirmed that Rosales was previously convicted of aggravated assault with a weapon and sentenced to six years in prison.

"When individuals kill law enforcement officers, it represents a much more dangerous threat to the public," said Dale L. Wilcox, executive director and general counsel of IRLI. "Anyone willing to kill a law enforcement officer would not hesitate to do the same to any member of a community. The fact that this suspect is an illegal alien with a criminal past is even worse. Cpl. Galloway's family should not be grieving today, because the suspect should have been removed from the country years ago."

A massive law enforcement manhunt over three days located Rosales in Mexico on Jan. 26. He was arrested and extradited back to the United States where he faces a capital murder charge.

The head of Cpl. Galloway's department in Harris County is Ed Gonzalez, the Biden administration's nominee to be director of Immigration and Customs Enforcement.

Virginia Fair Elections Announces Its Legislative Priorities

The Virginia Fair Elections Coalition is a group of policy organizations, grassroots activists and local election integrity committees. This Coalition is dedicated to supporting the ideals and legal processes involved in free and fair elections in Virginia. VFE supports full transparency of our electoral processes in order to ensure that all Virginians have confidence in every local, state and federal election held in the Commonwealth.

Significant changes to Virginia's elections were voted into law in 2020 and 2021 based on the Covid-19 pandemic restrictions. We fully support access to the ballot box for every eligible voter and will continue to advocate strongly for that right, however some laws currently in place do not allow for full transparency, create doubt about the fairness of our elections and have created numerous multi-layered bureaucratic processes that impact local registrars and their staff and their potential ability to fully and completely comply without unforeseen errors.

To that end, we stand in support of HB46, HB187, HB205, and SB80 and are working with the patrons of these bills. In addition, we support the passage of the following Senate bills: SB3, SB234, HB235, SB236, SB460, SB652, SB390.

Bryce Reeves Announces Endorsement by Paul Galanti

FREDERICKSBURG, VA
January 7, 2021

Today, Senator Bryce Reeves (R-Spotsylvania) is proud to announce the endorsement of Navy Commander Paul Galanti. Galanti is a highly decorated Vietnam War hero who was featured on the cover of both Time and Life magazines for having spent over six years in a Vietnamese prisoner of war camp, commonly known as the Hanoi Hilton. Galanti also served as the Virginia Department of Veterans Services Commissioner.

Paul Galanti stated, "Bryce represents the absolute best definition of leadership - as a member of our Special Forces, as a state political official and as someone who'll make a difference draining the embarrassing swamp our nation's capital has become. He keeps his word, and as all good leaders, always takes care of others before himself"

Bryce Reeves stated, "I've had the privilege of working with Commander Galanti over many years. I consider him a close friend, and I'm so impressed by the work he has done advocating for our veterans. It is a great honor to have him on my team."

Since leaving the service in 1982, Galanti has been a major proponent for veterans causes, especially POWs. He is active in numerous organizations, both in the Commonwealth and nationally, that advocate on behalf of veterans.

He has had a major outpouring of support from law enforcement officials, including the endorsements of seven sheriffs from across Virginia. Bryce Reeves has also received the endorsement of local conservative leaders including Del. Nick Freitas (R-Culpeper), former Speaker Bill Howell (R-Stafford), and Spotsylvania Commonwealth Attorney Travis Bird as well as national groups and leaders such as former Secretary of Energy Rick Perry, SEAL PAC, and FreedomWorks.

The Most Important Recommendation for Ending Family Separation is to End Policies That Create the Problem, Says FAIR

(January 11, 2022, Washington, D.C.) —The Department of Homeland Security (DHS) created an interagency task force to address the issue of families that were separated as they attempt to migrate illegally into the United States. In response to a request for public input, the Federation for American Immigration Reform (FAIR) submitted a comment urging the department to end a host of policies that encourage adult migrants to traffic children illegally across the border and that increase illegal immigration into the United States.

"The focus of the task force seems to be on how to reunite families that have been separated as a result of their decision to enter the United States illegally," observed Dan Stein, president of FAIR. "Rather, the emphasis here should be on ending numerous incentives that encourage migrants to risk family separation in the expectation that some, if not all, family members will be allowed to remain in the United States. The goal should be to prevent family separation from happening at all."

To properly prevent family separation, FAIR says DHS must:

  • Fully reinstate the Migrant Protection Protocols (MPP) or otherwise implement section 235(b)(2)(C) of the Immigration and Nationality Act;
  • End the 1997 Flores Settlement Agreement;
  • Increase DHS's family detention capacity;
  • Reunite unaccompanied alien minors with their families in their home countries;
  • Rescind non-enforcement policies and resume worksite enforcement;
  • Reform the asylum system and require officers to apply mandatory bars to asylum and withholding of removal in credible fear screenings;
  • Terminate the unlawful DACA program; and
  • Maintain "Last In, First Out" asylum processing priorities.
"The likelihood of prompt release from detention and the availability of employment authorization has caused the number of family units illegally crossing the border to skyrocket to crisis levels in the past decade and, most drastically, in 2021," said Stein in the comment. "If inadmissible aliens are unable to be released into the United States until they are granted asylum and expect DHS to vigorously enforce immigration law, the number of apprehensions and fraudulent credible fear claims made by family units will drop significantly. The only way to permanently end family separation is to eliminate the pull factors that encourage family units to enter United States illegally."

"While the Biden interagency task force will undoubtedly focus on ways to repair the damage caused by their own policies, and ill-conceived policies of previous administrations, a far wiser approach would be to end those policies and fix broken laws. If you really want to end family separation – and we all do – then the best approach is preventing these tragic situations from occurring in the first place," Stein concluded.

IRLI Press Release: Illegal Aliens Are Getting Free Lawyers, and You’re Paying for It

IRLI exposes government funding for non-citizens charged with civil offenses

WASHINGTON—From coast to coast, numerous city and county governments are enacting taxpayer-funded programs that provide free legal representation to illegal aliens fighting deportation orders, an investigation by the Immigration Reform Law Institute (IRLI) has revealed.

In one glaring example discovered by IRLI, city officials in Philadelphia admitted that they administered no oversight over its deportation defense program, despite funding it with hundreds of thousands of taxpayer dollars.

A deportation defense program is any initiative that provides representation and/or other legal services to a non-citizen facing deportation proceedings, typically at reduced or no cost to the defendant. Under U.S. law, illegal aliens and other non-citizens facing deportation orders do not have a right to legal representation because immigration law is a civil matter, not a criminal one.

A progressive non-profit organization based in New York City, the Vera Institute of Justice, has served as the main catalyst for the proliferation of these deportation defense programs. The group claims that, out of the more than 50 publicly funded local and state deportation defense programs across the US, its SAFE Initiative (Safety & Fairness for Everyone) is formal partners with 22 of these communities.

"These programs are an insult to every law-abiding American citizen and legal resident," said Dale L. Wilcox, executive director and general counsel of IRLI. Our laws clearly state that non-citizens charged with civil offenses do not have a right to legal representation. Yet we have radical anti-borders groups starting these programs and sticking unknowing citizens with the bill. It's outrageous."

Vera typically provides one-time grants to localities initiating these programs, which fund legal services, with the aim of making these programs permanent.  The first such program began in New York City in 2013, dubbed the New York Immigrant Family Unity Project, with similar programs spreading since then. The growth of these deportation defense funds have not slowed down but proliferated. In the past year alone, new programs have been created while others have seen their temporary status made permanent and enjoyed increased funding. Vera says its goal is universal representation for individuals in immigration court – meaning any illegal alien in the country contesting a deportation order would be provided an attorney at no cost to them.

Philadelphia Mayor Jim Kenney announced the creation of the Pennsylvania Immigrant Family Unity Project (PAIFUP) in 2019, a collaboration between Vera and the city as a way to combat the alleged "hate" emanating from the Trump administration. PAIFUP was launched in 2019 with $100,000 from city taxpayers and another $200,000 from Vera and the Samuel S. Fels Fund, bringing a grand total of $300,000. The program was put in jeopardy in 2020 amid the COVID-19 pandemic, a time when nationwide lockdowns shuttered innumerable businesses, resulting in mass layoffs and leaving government budgets obliterated.

The Philadelphia government, faced with steep budget cuts, was poised to nix the program. However, the city's leaders somehow not only found a way to maintain the program amid a financial crisis, but doubled taxpayer commitment to $200,000 for next fiscal year. According to the PAIFUP's website, there are "no eligibility criteria other than income and a lack of private counsel," adding that they do not "exclude individuals based on prior criminal convictions, residency, or any other reason."

IRLI submitted a records request with the city of Philadelphia for a complete list of the charges (excluding any Personally Identifiable information (PII)) associated with those represented by PAIFUP and all operational guidance handed to program administrators by the city.) That request was denied by the city. In response to an IRLI appeal, the City of Philadelphia stated clearly that it can't provide such information simply because it does not provide any sort of management or oversight over the program – despite providing hundreds of thousands of taxpayer dollars annually to the program.

Much like other towns and cities across the country, Fort Collins, Colorado, struggled with the economic downturn caused by the coronavirus lockdown. So much so, city leaders anticipated a 2021 budget cut of around $13 million – no small sum for a town of roughly 170,000. Despite the steep financial sacrifices citizens and city leaders were making, anti-borders advocates did not let up on their desire to see a taxpayer-funded deportation defense fund launched.

Illegal alien advocates got their wish when, during a July 6, 2021 meeting, the Fort Collins City Council passed Ordinance No. 64, which established the creation of an immigration defense pilot program. The program came with a $150,000 budget, entirely funded with taxpayer money.

The seven-member city council greenlit the defense fund by a vote of 5-2. However, members of the community expressed concern over a potential conflict of interest with the vote (some of whom reached out to IRLI) by noting that two members of the city council have connections to The Family Center/La Familia, an organization that provides legal services to immigrants and stands to benefit from the creation of the pilot program.

Council members Tricia Canonico and Emily Francis, both of whom voted in favor of the measure, have apparent ties to The Family Center. Francis is currently listed on the Center's staff page and described as a Partnership and Grants Director. The LinkedIn page for Canonico identifies her as a board member of the Center since June 2020, and she also identified herself as a board member in a March 2021 local news article. She may have stepped down since then, as she is no longer listed as a board member of the Center's current board website.

Millions in taxpayer dollars are spent every year by the 22 local and city governments that are formal partners with SAFE. Upon researching every SAFE partner, IRLI estimates that at least $5.6 million dollars will be spent by taxpayers living in these communities for the 2022 fiscal year. This is a conservative estimate and does not include numerous other localities that fund their own independent anti-deportation programs.

Virginia Constitutional Conservatives Launches Repeal of Red Flag Gun Grabs

January 7, 2022

Leesburg, Virginia- The Virginia Constitutional Conservatives has launched a new effort in Virginia, the total and complete repeal of Red Flag Gun Grabs.

"Using our no-compromise, confrontational model, we will be working nonstop to repeal the unconstitutional and immoral gun grab scheme passed by the left-wing radicals in 2019," said S. Chris Anders, Director of the Virginia Constitutional Conservatives.

The Virginia Constitutional Conservatives (VCC) is the fastest growing grassroots group in Virginia.  Using proven, head-on, full-contact politics, VCC stopped Northam's Gun Ban in the 2020 General Session and stopped the 2021 Homemade Gun Ban.  VCC has teamed with Delegate Marie March (R-7) who is introducing legislation to completely repeal Red Flag Gun Confiscation.

"The primary duty of a State Delegate is to protect the individual liberty of those they represent.  These gun grabs, without due process, violate nearly half of the Bill of Rights."  Said Delegate Marie March. " There can be no compromise.  The voters of my District elected me to represent them and defend their constitutionally protected right to keep and bear arms and their right to due process.  The Constitution is very clear, before you can lose your life, liberty or property, you must have your day in court.  And that bill restores that right."

"Using hard-hitting mobilization tactics, we rained political pain on poor performing politicians, regardless of what party affiliation they claim, "Anders continued. "In the last 24 months, we have sent out over 5 million phone calls, nearly a million text messages, 10.7 million emails and reach an average of half a million conservatives in Virginia a month on social media with one goal: to mobilize conservatives to confront politicians.  Now we will do the same to demand that State Politicians of both parties vote to repeal this violation of the 2nd, 4th, 5th and 6th Amendments.  Gun Confiscation, without due process, is the primary reason the patriots of 1775 rebelled against the British."

Citizens of Other Nations Being Used to Disenfranchise New Yorkers, Charges FAIR

(January 10, 2022, Washington, D.C.) — Dan Stein, president of the Federation for American Immigration Reform (FAIR), issued the following statement in response to New York City Mayor Eric Adams allowing a bill to become law that would permit citizens of other nations – including some illegal aliens – to vote in citywide elections:

"America was founded on the principle that sovereign people should determine their own destinies. Yesterday, the new mayor of our nation's largest city unequivocally rejected that founding principle by empowering citizens of other nations to determine the outcome of local elections.

"The right to vote is at the very core of the principle of self-determination and what it means to be a citizen. By allowing this extreme voting bill to become law, Mayor Eric Adams has taken the most damaging step in the Democratic Party's ongoing efforts to erase any distinction between American citizens, green card holders, guestworkers, and those here illegally.

"About 1.1 million votes were cast in the recent mayoral election. With the addition of some 800,000 foreign nationals to the voter rolls, they will almost certainly have an impact on the outcome of future elections. This number is sure to grow due to an increase in all forms of immigration under President Biden, as well as the fact that you only have to live in the city for 30 days to be eligible to vote.

"The actions of the City Council and new Mayor Eric Adams will harm all Americans in New York City, as citizens of other countries will decide how they are governed – which is the very antithesis of self-determination. We encourage New Yorkers to challenge this measure in court, as it violates the state's constitution and election law."

Victory! Ninth Circuit Rejects Lawless Reentry

December 16, 2021

Holds illegal entry is determined by law, not border patrol oversight

WASHINGTON—In a case with clear relevance to the current crisis at the border, the full Ninth Circuit Court of Appeals, sitting en banc, handed down a decision Tuesday making abundantly clear that whether a foreign national has unlawfully entered the United States is determined by the law, not the actions or inaction of the border patrol. The Immigration Reform Law Institute (IRLI) had filed a friend-of-the-court brief in the en banc proceeding urging the Court to reach that result.

The case involved an illegal alien from Canada who, having been deported previously for a drug offense, was "waved through" a checkpoint back into the United States by a border patrol agent. The alien claimed that this action by the border patrol agent made his reentry lawful, and a three-judge panel of the Ninth Circuit agreed.

The full Ninth Circuit ordered rehearing en banc, vacated this judgment, and issued a diametrically opposite ruling. The Court held that whether a given entry by an alien is lawful or unlawful is determined by the law, not mistakes, oversights, or supposed "waivers" by the border patrol. And the law was clear that this alien had entered illegally, due to his prior deportation based on his drug conviction.

"Coming now, this ruling is especially important," said Dale L. Wilcox, executive director and general counsel of IRLI. "It makes clear that the administration's laxity at the border by no means legalizes the current flood of illegal entries. If strong enforcement comes back, that fact—and this ruling—will foreclose any claim of lawful presence by illegal aliens now being let in en masse. We applaud the full Ninth Circuit for this strong, timely decision."

Sen. Suetterlein Files Tax Relief Legislation for Working Families

Would provide up to $517 in state income tax relief and allow local car tax refunds

RICHMOND - Virginia's outgoing Governor Ralph Northam is spending his final days in office announcing new spending proposals he did not pursue during his party's two-year monopoly on state government and record tax payments. At the same time, tax relief legislation aligned with Governor-elect Glenn Youngkin's campaign pledges to lower the cost of living for working Virginians is being filed in the General Assembly.

Senator David Suetterlein (R-Roanoke County) has filed bills that would double Virginia's standard deduction and allow localities to provide refunds on personal property taxes paid on cars and trucks.

Raising the Standard Deduction - Giving up to $517 back to Working Families
Sen. Suetterlein's Senate Bill 11 would double Virginia's standard deduction to $9,000 for single tax filers and $18,000 for married taxpayers filing joining. This would provide tax relief of up to $258 for individual filers and $517 for couples that file using the standard deduction - something that 85% of Virginia taxpayers do.

Virginia's recent record personal income tax collections have played a significant role in generating the $13.6 billion more over three years than the $23.6 billion general fund budget in the last fiscal year.

"These chronic, multi-billion surpluses in Richmond are systemic over-taxation. Virginia has taxed all taxable personal earnings over $17,000 at the highest rate since the 1980s while also not raising the standard deduction enough. This coupled with inflation results in a series of regular, unlegislated tax increases on Virginians that needs to be reversed," said Sen. Suetterlein.

Providing Car Tax Relief
Sen. Suetterlein's SB12 would authorize local governments to return surplus personal property tax revenue to taxpayers.

The tightening supply of motor vehicles available for purchase in the last year has shot up market prices and the resulting local tax assessments. Many Virginians will soon find themselves paying higher personal property taxes on their vehicles than they did when they were newer.

"It is unclear how long this unusual car market will continue, but in the mean time its important that counties have the ability to provide targeted relief," said Sen. Suetterlein.

Additional 2022 Legislation
In advance of the 2022 General Assembly, Senator Suetterlein has also filed SB3 requiring absentee votes to be counted by precinct instead of murky, central absentee pools; SB4 limiting the duration of emergency executive actions; and SB5 that would make Parole Board votes public.

All 19 bills already filed by legislators for the 2022 General Assembly may be viewed on Virginia's Legislative Information System website. The website is continuously updated as more bills are filed.

Senator Suetterlein also plans to introduce additional bills including those related to K-12 education, healthcare, energy, and campaign finance between now and the start of the 2022 General Assembly on January 12.

"It is going to be a new day with new opportunities in the Commonwealth when Governor Youngkin is inaugurated. We need to aggressively pursue the bipartisan opportunities to improve the lives of Virginians," said Sen. Suetterlein.

Virginia Senator David Suetterlein was elected in November 2019 to a second term representing Salem and Bedford, Carroll, Floyd, Franklin, Montgomery, Roanoke and Wythe counties in the Virginia Senate.

Should Aliens who Seriously Injure their Victims Stay?

IRLI shows why Michigan's crime of aggravated assault involves moral turpitude

WASHINGTON—Today, the Immigration Reform Law Institute (IRLI) filed a friend-of-the-court brief with the Board of Immigration Appeals, the nation's immigration appellate court, on the legal issue of whether an alien who has been convicted of aggravated assault in Michigan has committed a "crime involving moral turpitude" under federal immigration law, and thus should be deported.

To be convicted of aggravated assault in Michigan, one must intentionally assault another person (by, at the minimum, making that person fear immediate physical attack), and also cause serious bodily injury to that person. IRLI points out in its brief that this requirement of actual serious injury makes the crime one involving moral turpitude; as one court cited by IRLI noted, serious injury to the victim shows that the attacker used a high level of force. IRLI also shows that the crime of aggravated assault in Michigan historically has been charged against perpetrators who engage in depraved, highly violent conduct, and never in the hypothetical situation of a perpetrator who assaults his victim intentionally, and in so doing somehow causes the victim serious injury inadvertently.

"Violent criminals are certainly not who we want among our legal immigrants," noted Dale L. Wilcox, executive director and general counsel of IRLI. "Public safety, and the moral character of lawful permanent resident aliens, is crucial both to the nation and to those aliens themselves, who are eligible to adjust to American citizenship. Accordingly, Congress provided that legal aliens who commit crimes involving moral turpitude should be deported. As we hope the Board sees, this law should be interpreted straightforwardly, not riddled with loopholes that further endanger Americans."

The case is Amicus Invitation No. 21-17-11 (BIA).
