Latest Federal Assault on Freedom

That is the word to describe the latest federal assault on the freedoms of America's working men and women. In the latest example of over-reaching by the intrusive federal government, the National Labor Relations Board (NLRB) is attempting to block the Boeing Corporation from moving some operations from the State of Washington to South Carolina. South Carolina, like Virginia, is a Right-to-Work state where men and women are not compelled to pay union dues as a condition of employment.

Nowhere in the Constitution is power granted to any appointed group - or the unelected bureaucrats who staff them - to dictate to American companies where they can or cannot locate their businesses and create jobs. This unprecedented power grab can only be seen as an unconstitutional restraint of free trade within the U.S. This decision by President Obama's administration should send shock waves through every Right-to-Work state in the country, including our Commonwealth of Virginia.

Right-to-Work laws are a matter of personal liberty - they protect working men and women from being forced to join a union and pay dues just to get a job. As Governor I saw firsthand how Virginia's Right-to Work laws made our state more competitive for recruiting businesses and creating jobs here in Virginia. Being the furthest state North on the Eastern Seaboard with Right-to-Work laws gives Virginia a great competitive advantage.

As Chairman of the Democratic National Committee, Tim Kaine chose to stand with big union bosses as they fought against reforms that would balance Wisconsin's state budget. Unlike Tim Kaine, I will always stand on the side of freedom and opportunity for Virginia's working men and women, not on the side of big union bosses.

Facing crushing financial burdens, lawmakers took on the labor unions and voted to strip collective bargaining rights from teachers, police officers and government employees with the goal of saving taxpayers $100 million in the next year alone. Can you name that state?

If you said Wisconsin, Ohio, Florida or New Jersey, you'd be wrong. The latest state to tackle the fiscal mess created by the unions is … Massachusetts!

Tuesday, the Democrat-dominated state House voted 111-to-42 to roll back collective bargaining rights.

That Massachusetts liberals are following the example of conservative Republican governors would seem like news. But the liberal media have no desire to explain to you that conservative ideas actually work. They want you to think that Republicans are dysfunctional and can't run anything. The media's double standard is disgusting, and matched only by the hypocrisy of the left.

Where were the union protestors? Where were the college students and radical activists storming the state House in Boston? I guess it is okay when Democrats "assault unions" and workers' rights. By the way, where are all the anti-war protestors marching against Obama's war of choice in Libya? Did Obama go to war for Libya's oil?

Obama Board Threatens Right To Work

While the economy is suffering from high unemployment, the Obama Administration is taking steps to prevent the creation of new jobs in America and threatening a fundamental right recognized in nearly half of the states -- the right to work.

Today's Wall Street Journal reports that the National Labor Relations Board has intervened on behalf of Obama's union allies to shut down a Boeing 787 plant in South Carolina that would employ more than 1,000 people. Why? Because the International Association of Machinists and Aerospace Workers demanded it.

Boeing initially wanted to build the planes at its Puget Sound plant in Washington state. But when it began negotiations with the union, the union demanded "a seat on Boeing's board and a promise that Boeing would build all future planes in Puget Sound." Unwilling to give in to such unreasonable demands, Boeing made a commonsense economic decision to move the plant to South Carolina -- a right to work state.

The union filed a complaint with the National Labor Relations Board claiming that Boeing made the decision to open a new plant in South Carolina in order to harm the union. After 17 months of construction and $2 billion invested in the plant, the board is now asking a judge to shut down the plant before it opens in July.

If the union succeeds, more jobs will be sent overseas. If big labor and big government are going to prevent American businesses from opening new plants in America, they will have no alternative but to open the plants overseas.

As the Journal notes, the episode is another example of the Obama Administration attempting to impose its radical anti-business agenda by regulatory fiat -- "no matter the damage to investment and job creation."

The Battle Of Wisconsin Widens

As the union-led protests in Wisconsin enter their eighth day, the big labor unions are going national. Today's Wall Street Journalreports that labor officials are planning protests in "dozens of other capitals." Meanwhile, Democrats in the Indiana state legislature launched their own "strike" with many leaving the state in order to prevent a vote on union reform legislation.

I know there are many good people who belong to unions. My father belonged to a union. The town I grew up in was very union oriented. Ronald Reagan was a union leader. But the idea that government employee unions should be treated the same as private sector unions and guaranteed collective bargaining rights is misguided.

Only 24 states currently grant all of their public sector employees collective bargaining rights, while several states have laws banning collective bargaining rights for government employees.

When a union sits down with the management of a private corporation, both sides are seeking to protect their self-interests. The unions want higher wages and better benefits. The company is seeking to contain costs while increasing productivity and profits. If the company doesn't give in, it faces a strike. It if gives too much, it risks profitability and a backlash from shareholders.

But when public sector union bosses sit down with governments, they aren't facing the taxpayers, who would likely drive a hard bargain. Instead, they are facing politicians, many of whom are either supported by the public sector unions or worried about the next election. This is why even the "patron saint" of the left and the labor unions -- Franklin Delano Roosevelt -- adamantly opposed giving collective bargaining rights to government employees. Here is what he said in 1937:

"All government employees should realize that the process of collective bargaining, as usually understood, cannot be transplanted into the public service. It has its distinct and insurmountable limitations when applied to public-personnel management. The very nature and purposes of government make it impossible for administrative officials to represent fully or to bind the employer in mutual discussions with government-employee organizations. The employer is the whole people…"

For decades, public sector unions have used the dues money of their employees to elect left-wing politicians who routinely vote for bigger government and higher taxes to pay for it. Today's Wall Street Journal reports that last year alone, the American Federation of State, County and Municipal Employees "tapped emergency accounts and took out loans as it poured more than $90 million into Democratic campaign efforts… Overall, unions put around $400 million into the 2008 campaign to help elect Mr. Obama and other Democrats."

And what is the return Wisconsin taxpayers are getting for all the additional spending? Not much, according to the latest data from the Department of Education. The voters are catching on. The latest Rasmussen poll finds that likely voters are siding with Gov. Scott Walker by a ten-point margin over the unions as he tries to rein in government spending.

By the way, these protests have once again demonstrated the left-wing impulse for incivility, as you can see here. Meanwhile, the Associated Press reported over the weekend that the University of Wisconsin School of Medicine is investigating fake sick notes handed out by some of its doctors at the union protests.

Democrats Own the 'Culture of Corruption'

Delving into the Democrat's DISCLOSE ACT

The United States House of Representatives recently passed the Democrats' DISCLOSE Act ("Democracy is Strengthened by Casting Light on Spending in Elections") in a vote of 219-206. Only two Republicans voted for the bill; Rep. Joseph Cao (R-LA) and Rep. Mike Castle (R-DE). 36 Democrats voted against the bill.

The bill was authored by Rep. Chris Van Hollen (D-MD) who chairs the Democratic Congressional Campaign Committee in an attempt to "right the wrongs" that Democrats claim the recent Supreme Court Citizens United decision opened.

The bill stifles free speech under the first amendment by requiring small businesses, corporations, and non-profit organizations to electronically file burdensome financial disclosure forms (which don't even exist yet) within 24 hours of independent expenditures; a $10,000 penalty is the result of failure to comply.

527s, unions, and non-profits will be required to disclose the identities of individuals contributing over $600. Union dues are well under $600, so they will be exempt from this requirement.

In a deal to insure passage of the bill, Rep. Van Hollen provided an exemption for the NRA from the disclosure requirements. He also expanded the exemption to cover other large special interest groups, like the Sierra Club, who would have had serious objections to the bill.

The bill is now in the Senate. Senator Chuck Schumer (D-NY) is sponsoring the Senate bill (S. 3295) which is expected to be taken up before the August 9th recess. If passed in its current form, the law will take effect in 3o days, which will make it applicable to this November's elections. The Federal Election Commission will not have a chance to draw up clear guidelines in regards to the legislation.

This act is little more than a cheap political move by Democrats to control who can speak out on issues.
