1. Elena Kagan brings no judicial experience to the table.

2. The Supreme Court will likely hear arguments on the constitutionality of Obamacare in the next few years. Elena Kagan could be the deciding vote on Obamacare.

3. Elena Kagan is a political ideologue-she has worked for a string of liberal Democrats including: Bill Clinton, Janet Reno, Barack Obama and Eric Holder.

4. As Dean of Harvard's Law School, Elena Kagan banned US military recruiters from the campus. She lost her battle when the Supreme Court unanimously upheld the law in 2006.

5. Elena Kagan's stand on several social issues could demonstrate that she would impose personal views in her rulings instead of adhering to the law. We need justices who will strictly interpret the constitution.

6. Elena Kagan has praised Israeli activist Judge Aharon Barak as "her hero." Judge Barak is considered to be one of the worst activist judges. In his book, The Judge in a Democracy, Barak writes, "a good judge is a judge who, within the bounds of legitimate possibilities, makes law that, more than other law he is authorized to make, best bridges the gap between law and society and best protects the constitution and its values. He also says that judges should go "beyond actually deciding the dispute."

7. Elena Kagan is a Litigation Committee member of the American Association of University Professors (AAUP). The AAUP is censoring a long list of conservative schools.

8. Elena Kagan has a troubling record on the Second Amendment.

Senator Jim DeMint got Senators Mark Warner (D-VA) and Jim Webb (D-VA) on record as supporting the corrupt system of earmark spending. They refused to quit earmarks for even one year.

On Tuesday night, I forced a vote in the U.S. Senate on a simple, one-year moratorium on congressional earmarks. Watch the video. Most Americans want to ban earmarks forever so a temporary timeout on pork-barrel spending is the least the Senate could do.

Unfortunately, the Senate defeated my amendment on a 68-29 vote. What's worse, 15 Republicans joined the Democrats to keep the congressional earmark favor factory open for business as usual.

The list of how each Senator voted is below. Please take a moment to contact your Senators to thank them for supporting the ban or to encourage them to admit they have a problem.

You might expect Senators to vote for the earmark ban to avoid a backlash from their constituents, but an earmark addiction is a hard habit to break. I know because I'm a recovering earmarker myself.

Many of these Senators mean well but the culture of spending in Washington turns good men and women against their own principles. It allows them to justify their actions to the point where they're not ashamed to trade their votes for a Cornhusker Kickback or a Louisiana Purchase.

It's disappointing that some use the Constitution to defend wasteful spending. Just because Congress has the power to spend taxpayer money doesn't mean it should use that power to put pet projects ahead of true national priorities.

Fortunately, a majority of Senate Republicans voted for the earmark ban, which was a first. Of the 41 Republicans in the Senate, 25 had the courage to call a one-year timeout.

Even more encouraging is that 11 Senate candidates in 8 states have now endorsed a ban on earmarks.

One of these leaders is Chuck DeVore who is the only candidate in the California Senate race to publicly endorse an earmark ban and a Balanced Budget Amendment. If you're tired of Barbara Boxer spending your money on "bridges to nowhere," support the true conservative in that race.

We didn't win the vote to ban earmarks this week but we must keep fighting. Until Congress breaks its addition to pork, we will never tackle the larger spending issues that are bankrupting our country.

Democrats Refuse to Renounce Reconciliation

In a speech Wednesday, President Obama called for Congress to "finish its work" on health care reform. Obama and the Democrats have laid out a tentative strategy to ram their health care bill through Congress with a 50 + 1 strategy.

Their strategy hinges on three critical votes: the House must approve the $871 billion Senate bill, and then both the House and Senate will vote on a budget reconciliation bill that will solve several objections to the Senate bill. It is a completely partisan strategy for the Democrats.

Unions Greed Threatens National Security

The National Right to Work Committee say that union bosses are exploiting the foiled Christmas Day terrorist attack by insisting on the forced unionization of all Transportation Security Administration (TSA) employees.
