Agreeing with IRLI, full court finds state law unconstitutional |
WASHINGTON—Yesterday, in a crucial victory, the full Ninth Circuit Court of Appeals, sitting en banc, struck down a California law that would have ended all alien detention in the state. The Immigration Reform Law Institute (IRLI) had filed a friend-of-the-court brief before the full court urging it to find this law unconstitutional.
Earlier, a three-judge panel of the Ninth Circuit also had struck down the law. But the full court vacated that decision and reheard the case en banc. In June, when IRLI filed its brief before the en banc court, Dale L. Wilcox, executive director and general counsel of IRLI, commented:
"As disturbing as it is that the full Ninth Circuit took up this case, in which the panel had reached the right result, we hope the full court will reach that same result for the reasons we provide, and acknowledge that this law flagrantly defies the Constitution."
In its brief before the full court, IRLI showed that the California law is preempted under the Constitution's Supremacy Clause because it intentionally interferes with the federal program of using contractors to house immigration detainees, that no "presumption against preemption" applies because immigration is exclusively an area of federal concern, and that the law also violates the immunity doctrine.
In its opinion yesterday, the full Ninth Circuit agreed with each of these points, finding the state law unconstitutional because it would veto the federal government's decision to use private contractors to detain aliens in California.
"We applaud the full court for recognizing that the intended effect of this law—to end federal detention of aliens in California—is what makes it unconstitutional," said Wilcox today. "Under our Constitution, a state may not interfere with—much less cancel—federal immigration law enforcement, and we are pleased that California's law attempting to do just that is no more."

Russell Co. Declares it’s a Pro-life Sanctuary!

The mainstream media won't share this information with you, but we will: the amazing people of Russell County, Virginia, have once again set the standard for the rest of the state by declaring itself a pro-life sanctuary! On September 12th, the Russell County Board of Supervisors, after listening to their constituents, passed a local resolution that declares the county to be a community that promotes the dignity of all human beings, from conception through natural death.
They are now the first locality in Virginia whose elected body passed a resolution that vows to do everything within its powers to protect the full humanity of the preborn child. Here are some of the strong declaratory statements contained within their resolution:
- "The Russell County Board of Supervisors hereby recognizes and declares the full humanity of the pre-born child … where the dignity of all human beings, from conception through death, will be defended and promoted."
- "The Russell County Board of Supervisors hereby resolves to enforce this resolution by all means within its power…"
Now their achievements have inspired Tazwell County to consider a similar resolution affirming the dignity from conception to natural death at its October 4th BOS meeting. We can't let Russell County (and maybe Tazwell) be alone – every pro-life citizen should help spread pro-life sanctuaries statewide!

Congressman Bob Good: Protecting Our Children
At the press conference, we heard from Chloe Cole, whose parents followed the advice of so-called medical professionals who performed life-altering surgery on her as a child. Chloe's story is filled with regret and illustrates that children need the right kind of caring support to help guide them through the most difficult times in their lives.
NO elected official should stand silently by while our children are subjected to permanent physical mutilation of their bodies or dangerous hormonal treatments in the false name of "gender affirming care." And medical providers need to be held accountable for any bodily harm they inflict on a child.
That is why I joined Rep. Marjorie Taylor Greene's (GA-14) courageous stand in introducing the Protect Children's Innocence Act. I hope others will add their support to this commonsense legislation and help us end this abusive malpractice.

Friend, This past year Republicans have made strides in restoring common sense law and order in the Commonwealth. We at the Republican Party of Virginia want to highlight the fantastic work our Delegates and Senators in the General Assembly were able to accomplish this past session. Today we highlight the Chair of the Courts of Justice Committee in the House of Delegates, Rob Bell. In the past legislative session, Delegate Bell was the Chief Patron on many Bills that would end up becoming law. He spearheaded HB 741, which requires local school boards to have an updated floor plan for each district's public primary and secondary school. Keeping these floor plans up to date is critical in ensuring that any emergency services can take action more accurately and more effectively. Delegate Bell also sponsored HB 740, which makes it a Class 6 Felony to tamper with or steal a catalytic converter from a vehicle in the Commonwealth. Earlier this year, many heard stories about neighbors losing catalytic converters, and Delegate Bell took action. Thank you to Delegate Bell for keeping our students and our personal property safe! Republicans are leading the way to make Virginia the best place to live, work, and raise a family. The coalition is a unified effort of AFP, Heritage Foundation, Middle Resolution, the Family Foundation, and other orgs committed to education freedom in Virginia. Our work includes legislation to provide for parental choice for a student's education path.

GOP's "Commitment to America" promises to end border surges and mandate E-Verify
House Republican Leadership committed to passing legislation as part of their "Commitment to America" that would end the border crisis, prevent future border surges, and significantly reduce illegal immigration.
House Minority Leader Kevin McCarthy (R-Calif.), Minority Whip Steve Scalise (R-La.), and GOP Conference Chair Elise Stefanik (R-N.Y.) officially announced the Commitment at a public event in Pennsylvania earlier today.
The Commitment includes:
- Fully funding effective border enforcement strategies, infrastructure, and advanced technology to prevent illegal crossings and trafficking by cartels
- Ending catch-and-release loopholes
- Mandating E-Verify
- Eliminating welfare incentives
While the Commitment is light on details, it's a significant step forward for the House GOP Leadership. In the past, GOP Leaders have been reluctant to talk about anything other than border funding. But the Commitment recognizes the impact that implementing a nationwide workplace verification system would have on discouraging mass illegal immigration and visa overstays and how critical closing the loopholes, mostly within the asylum process, are to preventing border surges.
NumbersUSA issued the following statement commending the "Commitment to America:"
The Biden border crisis has led to more than 3.3 million apprehensions of illegal border crossers since early last year. Instead of addressing this record-level crisis, Pres. Biden has absolved himself of all responsibility. House Republicans, through their "Commitment to America", promise to tackle the ongoing border crisis head on and hold the administration accountable.
In addition to providing adequate funding to secure the border and enforce immigration laws already passed by Congress, the Commitment promises to close the loopholes - like catch and release - that have been exploited by the Biden Administration and illegal border crossers alike.
Just as importantly, the Commitment promises to protect American jobs from illegal aliens by requiring the use of E-Verify. NumbersUSA applauds the House GOP's commitment to end the ongoing border crisis and prevent future border surges, and we look forward to working with House Republican leaders as they follow through on this commitment.
Obviously, holding the House GOP to their commitment to mandate E-Verify and close the loopholes won't be an easy task. But we're confident that NumbersUSA activists and other concerned citizens will hold GOP House Members to their promises should they take control of the House in the 118th Congress.

Today, we highlight Senator Todd Pillion from Southwest Virginia. This past Legislative Session, Senator Pillion sponsored SB600 which requires local School Boards to work with the localities Chief Law Enforcement Officer when conducting yearly safety audits. Previously the Superintendent was only required to provide a copy of the audit to Law Enforcement upon request. Senator Pillion also spearheaded SB 726 which makes it the official policy of the General Assembly to encourage agricultural production in the Commonwealth with specific emphasis on the livestock industry. Providing our farmers with incentives to ramp up production will help every Virginian when they go to the grocery store. Thank you Senator Pillion for all your hard work this past session! |

Obenshain Releases Statement on the 2022 Model Policies on the Privacy, Dignity, and Respect for All Students and Parents
Updated Policy for Virginia's Public School Systems
HARRISONBURG - Today, Senator Mark Obenshain (R-Rockingham) released the following statement in response to the just-released 2022 Draft Model Policies on the Privacy Dignity, and Respect for All Student and Parents from the Virginia Department of Education:
"I applaud the 2022 Draft Policy released today by Governor Youngkin and the Virginia Department of Education. This policy was crafted in compliance with the 2020 law signed by then-Governor Northam and patroned by Delegate Marcus Simon and Senator Jennifer Boysko.
Last year, when then-Governor Northam released his administration's draft model policy, it flatly ignored the rights of students and parents. It went so far as to prohibit school staff from notifying a parent or guardian if a student requested affirmation of his or her gender identity. It even suggested that there was an obligation for school officials to report parents to the Department of Social Services if they suspected them to be insufficiently supportive of their child's gender identity. The Northam model policy was so extreme and out of touch with communities across Virginia that it was adopted by only approximately 10% of the school divisions in Virginia. This notwithstanding the statutory mandate that it be adopted by every school division. The 2020 legislation requiring the adoption of this policy was just a bad idea and it accomplished little beyond making Virginia schools an even bigger cultural battleground than they already were.
Parents must be involved in their children's education. Period. A child's development is acutely susceptible to influence and it is the responsibility of parents to play a central role in shaping and molding that development.
To the extent that the law requires adoption of a model policy by school divisions across Virginia, I support this new draft model policy which fully complies with the Code of Virginia. And I strongly suspect that the 90% of school divisions across Virginia that were unwilling to adopt the old policy will find themselves much more comfortable with this policy.
I hope that parents, teachers, administrators, and school board members across Virginia will work together to adopt policies that will respect parents' rights and ensure our children are treated fairly and equitably in a safe environment."
